<br /> <br />I was not r_onfused about the orientation as was no one else <br />I asked after the issue came up. .1ohn Nelson, Jim McArdle, <br />and Dave Bucknam are the only three people in the world that <br />believe the point of the V-shape should be upstream. This <br />configuration actually parts the water and makes it run <br />around the structures, not over them as the way the one <br />poured with the V going downstream does. <br />ITEM IF 7 AMOUNT - $1800.00 <br />This is for additional work on bid Item 3A,.Chens Hill <br />Damage Control with Riprap, which is referred to in i~7 above <br />relative to inspection. <br />This item was completed to a quality superior to that <br />required by the contract. By the contract it should have <br />had 110 cubic yards of riprap. CWL put 50 additional cubic <br />yard of riprap in this ditch when it was originally built. <br />CWL is asking for $800.00 in addition to the original bid <br />price of $1000.00 for the 2 times CWL went back ad added <br />rock after the project was properly completed. <br />The State failed to promptly inspect this work as required <br />by the contract. Three large rain storms first covered the <br />riprap, then stated eroding dirt and rock away at the lower <br />end of the ditch. Prompt inspection would have revealed <br />that CWL properly performed before these natural <br />occurrences. <br />Line Item 1l3A, for $1000.00 appears to be part of CWL's <br />unpaid invoices for a total claim of $1800.00. <br />I question the Owner assertion that it was inspected on 7- <br />20-94. However, it appears, from the weather reports that <br />the rain that caused the erosion problems and covered the <br />riprap occurred on 7-13, 7-21, 7-25 and 7-27-94. The state <br />also asserts that this ditch was not V-shaped. It was when <br />originally built and it had a 1 foot thick coarse of rip <br />rap. The reason it was not V-shaped, and their assertion <br />that there was not enough riprap in the bottom, was because <br />it was silted full. DMG also asserts that the ditch was <br />overflowing into ENERGY FUELS sediment pond. This section of <br />ditch is below the sediment pond. DMG is trying Co blame CWL <br />for problems they created. 1. Deletion of mulch caused <br />excessive erosion on Chens Hill, silting the ditch full. 2. <br />the ditch may not be large enough to handle the rain, or <br />steep enough to carry away the silt. I built this ditch to <br />their specifications. On the DMG's final inspection form <br />John Nelson indicated that the only problem with this was <br />the riprap was thin in several spots. I also have the final <br />inspection form that was signed by John Nelson indicating <br />all the punchlist items were completed. <br />8 <br />
