They <br />deleted $11,300.00 of work of which CWL had invested <br />$8,670.00 towards completion. CWL is not demanding <br />anticipated profits, just payment. for the work performed. <br />The Owners agents lied to Sandra Brown when they stated "The <br />Owner has never received any documents of Costs incurred" <br />(see CWL letter dated July 19). This tried to explain to <br />them some of my costs. DMG doesn't want to pay. That was <br />the end of the issue as for as they were concerned. They <br />should have checked with CWL before deleting this work to <br />see what we had invested in it. If you ask John Nelson <br />under oath I'm sure he can confirm these machine hours spent <br />on this work. Mrs. Brown also has missed paying for the <br />channel shaping done in this area. DMG said it had been <br />paid for under 12c but only the channel in the bottom of the <br />trench was paid for. <br />ITEM 11 6 AMOUNT - $800.00 <br />The drawings included with the Special Conditions show a <br />plan view of the concrete drop structures CWL built. It is <br />unclear to this day which way they should face. The General <br />Conditions 1993 General Bid Specification 1111, "Plans and <br />Working Drawings", states: "The drawings if any, included <br />with this specification are complete and adequate for <br />construction." <br />CWL's subcontractors excavated for the first structure on <br />Saturday, June 13th. They also excavated for 2 more <br />structures that day, and set the forms for the second <br />structures. John Nelson was on site at 12:00 p.m., but <br />didn't inform anyone that he thought they were backwards <br />until 3:00 p.m. The concrete crew left and CWL almost <br />couldn't get them back. <br />In a phone conversation with John Nelson on June Z2, he said <br />they had finally found Harry Ranney, and he confirmed the <br />first structure had been built the way he had designed them. <br />This $800.00 claim is actual cost in labor and equipment to <br />remove the form works, backfil] the excavations, re-excavate <br />re-set forms, with overhead. <br />CWL has requested compensation on this work. DMG has <br />offered $400.00, half the cost. When asked how they arrived <br />at [heir figure, they said by cutting CWL's cost. <br />7 <br />
