<br /> <br />for a change order on this, but it also was denied, and as <br />of yet it is un-billed. <br />Mrs. Brown was misled by DMG the one hour of equipment <br />rental time that was paid for on Nov. 1 was for building a <br />small burm in the north end area where an old road went <br />threw it. It was, I believe, to control water' and put <br />traffic on the new road. See DMG letter dated Oct. 7, 1i3. <br />as 3rd paragraph and DMG letter dated Aug 26, A2, and CWL <br />letter dated July 19, first paragraph of the cost breakdown <br />"build a small burm where our temporary road went through <br />north end area". We built this at John Nelsons Request in <br />June and finally got paid in November. The other area in <br />Maggpie gulch has not been paid for. <br />ITEM ~ 3 AMOUNT - $315.00 <br />Without changing grades, we built a creek crossing at the <br />extreme South end of this project for' our own convenience. <br />There was no vegetation there at such time. At tyre <br />completion of work, we removed the crossing and reclaimed <br />this area to the same specifications as the other areas in <br />the contract, which was a better condition than before <br />construction. This area was included in the 75 acres to be <br />reclaimed in the Bid Documents. <br />John Nelson asked me to build three water bars at this area. <br />I told him that this was a change, and that if he wanted <br />water bar's, he would be required to pay for them. When I <br />was off the site he had an employee of mine do this work. <br />It took 3 1/2 hours to walk the dozer there and build the <br />water bars and return. We didn't remove any trees or brush <br />or change grades in association with our work in this area. <br />The demobilization clause in the Special Conditions states <br />that "additional final grading shall be accomplished, if <br />needed to reduce steep slopes." The water bars actually <br />increased the steepness of this slope. I have requested a <br />change order' for this work, but it has been denied. This <br />item is as of yet, still un-billed. <br />This work was not in the drainage as DMG asserts but on the <br />lower' edge of what the DMG had identified as topsoil. I <br />repeat these water bars were not in the drainage but in an <br />area that was included in the 75 acres to .be reclaimed. <br />ITEM 11 5 AMOUNT - $ 8670. <br />In change order,ll2 dated 5-26-94, DMG deleted from the <br />contract line item 1112A East Pit Channel with erosion mat, <br />(f12B East Pit Channel with erosion mat and riprap and 1112D, <br />3 each drop structures. CWL acknowledges their right to <br />delete these items and didn't proceed further with this <br />6 <br />
