This claim is for <br />the work to quarry rip rap for deleteri work (6 more <br />structures), along with compensation for the extra riprap <br />CWL plar_ed in the 6 structw~es built and the rundown area at <br />the far north end of the channel. <br />John nelson asked CWL to use the extra riprap in the <br />structures CWL had built and place some at the North end of <br />this channel where the channel ran out. of the project area. <br />He indicated at the time he would pay for this work. At. <br />other times tie balked when asked for compensation. CWL <br />placed some of this extra rock in the structure that were <br />built. Also some was placed at the North end of the channel <br />where it runs out of the project. <br />Please see the estimated quantities clause of the General <br />Conditions. CWL demands to be paid for the portion of the <br />deleted work that CWL did prior to it being deleted, also <br />for the extra work that John Nelson requested. John Nelson <br />needs to be questioned under oath. <br />ITEM /f 12 AMOUNT - $40.000.00 <br />The first stockpile of topsoil just north of Chens Hill <br />extended six foot below al] the surrounding areas. It was <br />200 feet wide by 300 feet long. We excavated, hauled and <br />placed this soil at a cost of $3.00 per cubic yard. At the <br />September meeting between John Nelson, Dave Bucknam, Jim <br />McArdle and myself, they ar_knowledged that this constituted <br />a change of conditions. At this meeting we also mutually <br />agreed that $3.00 per cubic >•ard was the actual cost of <br />placing topsoil on this project. <br />With this claim, CWL requests to be paid for this change of <br />conditions. <br />I believe Dave Bucknam and John Nelson need to be put under <br />oath to testify about this. In our September 26th meeting <br />Dave Bucknam was explaining to CWL what constituted a change <br />of conditions and what didn't. Regarding topsoil he <br />explained that if a pile extended below all the surrounding <br />ground level that that would he a r_hange of r_•onditions and <br />would be paid .for above the lump sum bid price. At that time <br />I told him that this was exactly what happened in the first <br />stockpile North of Chens Hill. At. [hat time John Nelson <br />confirmed this. Also at this meeting Dave Bucknam and CWL <br />calculated the per cubic yard price based on our equipment <br />rental rates and the volumes of material being moved and <br />came up with a per cubic yard price of $3.00. <br />ITEM !/ 13 AMOUNT - $4480.12 plus additional accruals <br />(interests) <br />10 <br />
