<br />-4- <br />Stipulation No. 8_ <br /> <br />PRIOR TO SECONDARY OR RETREAT MINING AT THE MAXWELL MINE, THE PERMITTEE <br />SHALL PROVIDE A HYDROLOGIC SURVEY IDENTIFYING ALL ALLUVIAL AQUIFERS IN, <br />OR ADJACENT TO THE PERMIT AREA (EXCEPT FOR THE PURGATOIRE RIVER ALLUVIAL <br />AQUIFER WHICH HAS ALREADY BEEN IDENTIFIED). THIS SURVEY SHALL CONTAIN <br />INFORMATION CONCERNING DEPTH BELOW THE SURFACE, HORIZONTAL EXTENT, WATER <br />USE, AND QUANTITY AND QUALITY OF GROUND WATER AS REQUIRED UNDER RULE <br />2.04.7(1). THE PERMITTEE SHALL ALSO PROVIDE A DISCUSSION OF THE <br />PROBABLE HYDROLOGIC CONSEQUENCES OF MINING UPON THOSE ALLUVIAL AQUIFERS <br />IDENTIFIED. <br />Stipulation No. 9 <br />PRIOR TO THE DISPOSAL OF ANY WASTE MATERIAL (i.e. DEVELOPMENT WASTES, <br />COAL PROCESSING WASTES, REFUSE, ETC.) ON THE ALLUVIUM OF CIRUELA CANYON, <br />THE PERMITTEE SHALL: <br />A) INSTALL A DOWNGRADIENT MONITORING WELL IN THE ALLUVIUM OF CIRUELA <br />CANYON WHICH IS COMPLETED INTO BEDROCK; <br />B) CONDUCT A PUMPING TEST ON THE ALLUVIUM TO DETERMINE THE <br />PERMEABILITY, TRANSMISSIVITY, AND SPECIFIC YIELD OF THE CIRUELA <br />CANYON ALLUVIUM, OR PROVIDE EXTRAPOLATED INFORMATION FROM SIMILAR <br />ALLUVIAL AQUIFERS; <br />C) COLLECT BASELINE GROUND WATER QUALITY AND GROUND WATER LEVEL DATA <br />ON THE CIRUELA CANYON ALLUVIAL WELL; <br />D) ASSESS THE HYDROLOGIC IMPACTS OF THE DISPOSAL PILE AND DEMONSTRATE <br />THAT THE PROPOSED PILE DESIGN WILL MINIMIZE THE IMPACTS TO THE <br />QUALITY AND QUANTITY OF ALLUVIAL GROUND WATER IN CIRUELA CANYON AND <br />IN THE PICKETWIRE VALLEY. <br />E) SUBMIT THE ASSESSMENT AND DESIGN TO THE DIVISION FOR APPROVAL AS A <br />REVISION. <br />Stipulation No. 10 <br />AFTER A THOROUGH REVIEW OF THE BASELINE WATER QUALITY DATA, THE <br />OVERBURDEN CHEMISTRY DATA SUBMITTED BY CF&I, AND 7HE RECEIVING STREAM <br />STANDARDS, THE DIVISION REQUIRES MONITORING TO INCLUDE THE FOLLOWING: <br />A) MONTHLY MONITORING OF THE PURGA70IRE RIVER UPSTREAM OF 7HE MAXWELL <br />MINE, THE PURGATOIRE RIVER BELOW THE CONFLUENCE WITH CIRUELA CANYON <br />(OLD CHANNEL), AND THE MAXWELL MINE DISCHARGE. THE PARAMETERS TO <br />BE MONITORED INCLUDE FLOW, FIELD pH, FIELD ELECTRO-CONDUCTIVITY AND <br />FIELD WATER TEMPERATURE. <br />B) MONTHLY MONITORING OF THE PURGATOIRE RIVER ALLUVIAL WELLS UPSTREAM <br />AND DOWNSTREAM OF THE MAXWELL MINE, AND MONTHLY MONITORING OF THE <br />ALLUVIAL WELL IN CIRUELA CANYON. THE PARAMETERS TO BE MONITORED <br />INCLUDE GROUND WATER LEVELS, FIELD pH, FIELD ELECTRO-CONDUCTIVITY <br />AND FIELD WATER TEMPERATURE. <br />
