-5 7- <br />Roads at the Maxwell Mine currently consist of one access road and several <br />light use roads. Very little information on the roads was given, but from Map <br />12 and from inspections by the Division, it is evident that the existing roads <br />meet the requirements of Rule 4.03 for grade, embankment slopes and road cut <br />slopes. <br />From Map 13A, it is evident that the access road does not meet the culvert <br />spacing requirements of Rule 4.03.2(4)(e)(V)(A). Therefore, the following <br />stipulation is necessary. <br />Stipulation No. 24 <br />WITHIN 30 DAYS OF PERMIT APPROVAL, THE PERMITTEE MUST SUBMIT EITHER A <br />PLAN TO BRING THE ACCESS ROAD INTO COMPLIANCE WITH THE CULVERT SPACING <br />REQUIREMENTS OF RULE 4.03.2(4)(e)(Y)(A) OR A REQUEST TO USE ALTERNATE <br />CULVERT SPACING SPECIFICATIONS IN ACCORDANCE WITH RULE 4.03.2(4)(e)(V). <br />IF THE PERMITTEE REQUESTS THAT ALTERNATE SPECIFICATIONS BE USED, THE <br />REQUEST MUST INCLUDE A DEMONSTRATION THAT THE ALTERNATE SPECIFICATIONS <br />WILL NOT RESULT IN INCREASED EROSION. EITHER PLAN WILL BE SUBMITTED AS <br />A REVISION TO THE PERMIT. <br />Information on road ditches and culverts in Exhibit 16 was reviewed. All <br />ditches were found to be adequate and all culverts, with the exception of the <br />culverts in the Purgatoire River, were adequate. No information, with the <br />exception of size, was given on these culverts. Technical Revision No. 1 is a <br />plan to replace the existing culverts with a bridge. The plans for the bridge <br />were found to be in compliance with all applicable standards. However, since <br />no definitive schedule for the construction of this bridge was submitted and <br />the technical adequacy of the culverts has not been evaluated, the following <br />stipulation is necessary in order to comply with Rule 4.03.2(4)(e). <br />Stipulation No. 25 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST EITHER SUBMIT <br />EVIDENCE TO THE DIVISION THAT THE EXISTING PURGATOIRE RIVER CULVERTS ARE <br />CAPABLE OF PASSING THE PEAK FLOW FROM A 20-YEAR, 24-HOUR PRECIPITATION <br />EVENT, OR SUBMIT A SCHEDULE, AS A REVISION TO THE PERMIT, ACCEPTABLE TO <br />THE DIVISION, FOR CONSTRUCTION OF THE PURGATOIRE RIVER BRIDGE. <br />The applicant plans to transport breaker refuse to the disposal site via a <br />recently constructed access road. Appropriate design information has not been <br />submitted. Therefore, the following stipulation is necessary in order to <br />comply with Rule 4.03.2. <br />Stipulation No. 26 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT APPROPRIATE <br />DESIGN INFORMATION PERTAINING TO THE ACCESS ROAD TO THE REFUSE PILE. <br />The application contains no definitive reclamation plan for the roads. The <br />applicant stated, in a previous response, that certain roads may be kept as <br />part of the post-mining land use. The following stipulation is necessary to <br />make a finding of compliance with the road requirements of Rules 4.03.2(7) and <br />4.03.3(7). <br />
