<br />-49- <br />Stipulation No. 16 <br /> <br />WITHIN 12 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST PROVIDE THE <br />DIVISION WITH A PLAN FOR THE REDISTRIBUTION OF TOPSOIL AT THE MAXWELL <br />MINE. THIS PLAN MUST INDICATE, WITH REASONABLE SPECIFICITY, THOSE AREAS <br />WHICH WILL RECEIVE TOPSOIL DURING REDISTRIBUTION AND THE RELATIVE DEPTHS <br />OF TOPSOIL AND SUBSOIL WHICH WILL BE REPLACED ON THESE AREAS. THE <br />70PSOIL MATERIAL MUST BE REPLACED WHEN IT IS IN A RELATIVELY DRY <br />CONDITION. THIS PLAN WILL BE SUBMITTED AS A REVISION TO THE PERMIT. <br />Stipulation No. 17 <br />WITHIN 12 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE MUST PROVIDE A PLAN <br />TO THE DIVISION FOR THE RECLAMATION OF ALL DISTURBED SURFACE LANDS WHICH <br />WILL NOT BE RETOPSOILED DURING RECLAMATION. THIS PLAN MUST INCLUDE <br />ANALYSES OF AN APPROPRIATE NUMBER OF SAMPLES OF THE DISTURBED MATERIAL <br />TO DEMONSTRATE SUITABILITY OF THE MATERIAL TO 'A DEPTH OF 40 INCHES ON <br />THE BASIS OF TEXTURE, pH, ELECTRICAL CONDUCTIVITY, SAR, SATURATION <br />PERCENTAGE, PERCENT ORGANIC MATTER, SELENIUM, AND BORON. THE PLAN MUST <br />ALSO INCLUDE APPROPRIATE MEASURES WHICH WILL BE EMPLOYED DURING <br />PREPARATION OF THE DISTURBED SURFACE PRIOR TO SEEDING (i.e., REDUCTION <br />OF COMPACTION). <br />IF THE ANALYSES OF THE IN-PLACE MATERIAL INDICATE THAT SUCCESSFUL <br />REVEGETATION CANNOT BE ATTAINED, THE PERMITTEE MUS7 PROPOSE A PLAN TO <br />APPLY APPROPRIATE AMENDMENTS TO MAKE IT SUITABLE OR IMPORT SUITABLE <br />MATERIAL. IF AMENDMENTS OTHER THAN NITROGEN, PHOSPHORUS, POTASSIUM, <br />SULFUR, OR IRON ARE REQUIRED THE PERMITTEE MUST SUBMIT THE RESULTS OF <br />APPROPRIATE TESTS TO PROVE THE AMENDMENT MATERIAL IS SUITABLE FOR <br />REVEGETATION. THIS PLAN WILL BE SUBMITTED AS A REVISION TO THE PERMIT. <br />Topsoil will be placed in stockpiles above the operation. The stockpiles will <br />be protected by a temporary vegetative cover. All stockpiles are contained <br />within the sediment control system at the mine. <br />With the acceptance of the above stipulations, the operator is in compliance <br />with the requirements of this section. <br />XII. Vegetation - Rules 2.04.10, 2.05.4(2)(c) and 4.15 <br />Baseline vegetation information submitted by the applicant can be found on <br />page 2.04-15 of Vol. 1 and Exhibit 12 of Vol. II. The revegetation plan is <br />found in pages 2.05-31 through 2.05-33 of Vol. 1 and Exhibit 18 of Vol. II of <br />the permit application. This information has been reviewed by the Division <br />for compliance with the Rules and Regulations. <br />The applicant has provided two baseline vegetation inventories, one conducted <br />in 1980, the second in 1981. The 1980 survey did not sample pre-mine <br />vegetation communities, but selected "reference areas" and sampled within <br />these "reference areas". The 1981 survey sampled affected areas and reference <br />areas for Pinyon-Juniper, and grassland communities. The applicant has <br />provided information on cover, productivity, woody plant density, species <br />composition, and a vegetation map. <br />
