-50- <br />In the calculation of adequate sample size for parameters of the <br />Pinyon-Juniper community the applicant used a precision value of 0.2 instead <br />of the 0.1 value acceptable to the Division. Use of this value caused the <br />applicant to undersampie each parameter for the Pinyon-Juniper community. <br />Additionally, the applicant used a t value of 1.28 instead of 1.645 in the <br />calculation of adequate sample size for production in the affected area <br />grassland type. <br />As a result of these errors in sampling the applicant has not adequately <br />sampled the following parameters: <br />1. Pinyon-Juniper: vegetative cover in the affected area. <br />2. Pinyon-Juniper: vegetative cover in the reference area. <br />3. Pinyon-Juniper: production in the affected area. <br />4. Pinyon - Juniper: production in the reference area. <br />5. Pinyon-Juniper: woody plant density in the affected area. <br />6. Pinyon-Juniper: woody plant density in the reference area. <br />7. Grassland: woody plant density in the affected area. <br />8. Grassland: woody plant density in the reference area. <br />It is required that the applicant provide this baseline information. <br />Therefore, in order to comply with Rule 2.04.10, the following stipulations <br />are necessary. <br />The applicant has not provided a discussion of the acreages of each vegetation <br />type which have been or will be disturbed at the Maxwell Mine during the <br />remaining life of mine. This information is required to determine the <br />adequacy of the baseline sampling and reclamation/revegetation plan. <br />Therefore, in order to comply with Rule 2.05.3(2)(b), the following <br />stipulation is necessary: <br />Stipulation No. 18 <br />THE PERMITTEE SHALL SUBMIT TO THE DIVISION A TABLE OF THE ACTUAL AND <br />PROPOSED ACREAGES OF DISTURBANCE FOR EACH VEGETATION TYPE A7 THE MAXWELL <br />MINE WITHIN 30 DAYS OF PERMIT ISSUANCE. IF THE PINYON-JUNIPER <br />VEGETATION COMMUNITY COMPRISES 5 PERCENT OR LESS OF THE AFFECTED <br />ACREAGE, NO SAMPLING WILL BE REQUIRED. IF SAMPLING IS REQUIRED, A PLAN <br />MUST BE SUBMITTED TO THE DIVISION AS A REVISION TO THE PERMIT. <br />The Division has determined that the sampling of the grassland community <br />(affected and reference areas), with the exception of woody plant density, met <br />statistical sample adequacy. It was determined that the reference area and <br />the affected areas were not statistically equivalent for cover and <br />production. However, mean values for vegetative cover and herbaceous <br />production were greater for the reference area in both cases. In order to <br />comply with Rule 4.15.7(3), the following stipulation is necessary. <br />
