<br />-47- <br />The applicant has not projected the effects of full extraction mining on the <br />alluvial valley floor. The Division can presently make the above finding only <br />if no mining occurs under these canyons. Development mining should result in <br />no subsidence effects, and inflow monitoring at the Allen and Maxwell Mines <br />has shown that development mining will not significantly affect the alluvial <br />aquifers of Apache and Santistevan Canyons. <br />The followin stipulation is necessary to make a finding of compliance with <br />Rules 2.06.8 5) and 4.24.2. <br />Stipulation No. 14 <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER APACHE CANYON OR SANTISTEVAN <br />CANYON, THE PERMITTEE MUST SUBMIT TO THE DIVISION SUFFICIENT EVIDENCE <br />FOR THE DIVISION TO MAKE FINDINGS THAT SECONDARY OR RETREAT MINING UNDER <br />THESE CANYONS WILL: <br />1) NOT INTERRUPT, DISCONTINUE, OR PRECLUDE FARMING ON THE ALLUVIAL <br />VALLEY FLOORS. <br />2) NOT CAUSE MATERIAL DAMAGE TO THE QUANTITY OF GROUND WATER THAT <br />SUPPLIES THE ALLUVIAL VALLEY FLOORS. <br />3) PRESERVE THE ESSENTIAL HYDROLOGIC FUNCTIONS OF THE ALLUVIAL VALLEY <br />FLOORS. <br />With satisfactory resolution of the stipulations, the proposed operation will <br />be in compliance with requirements of this section. <br />IX. Water Ri~hts and Replacement -Rules 2.04.7(3), 2.05.6(3)(a)(ii <br />~-7n-ri ~' ,, r-~-a~r <br />Portions of the application dealing with water rights can be found on pages <br />2.04.9 through 2.04-11, 2.05-2, 2,05-4, 2.05-43 of Vol. I, and Exhibit 8 of <br />Vol. II of the application. <br />Information concerning water rights was submitted to and reviewed by the State <br />Engineers Office. Based on their review and memos and correspondence <br />contained in both Water Resource Division files and Mined Land Reclamation <br />Division files, the Division has determined that the proposed operation is in <br />compliance with the requirements of this section. <br />X. Climatological Information and Air Resources -Rules 2.04.8 <br />3'7SG~rr31TG1~ <br />Baseline information presented in the application in Section 2.04.8 and Tables <br />8 and 9 dealing with climatic conditions and Exhibit 19 dealing with air <br />resources protection have been reviewed by the Division for compliance. The <br />applicant has supplied all of the information required by the Rules and <br />Regulations. <br />The proposed operation is in compliance with the requirements of this section. <br />
