• The hours of operation will be, 6 am to 6 pm, Monday through Friday. There may <br />be operations on weekends to respond to emergency situations. <br />• There wilt be three employees on the site during business hours. <br />• There will be a temporary building and heavy equipment to move the materials. <br />• Fencing will be used to secure the site. <br />• There will be a screening process to screen materials before they are used as fill. <br />• Three ground water monitoring wells will be installed. <br />• Records will be maintained for all deliveries on a daily basis. <br />• No contaminated soils will be allowed. <br />• Six to twelve inches of soil will be placed on the fill as a cap. <br />• Watering from trucks will be used to control any fugitive dust. <br />ANALYSIS: The proposal to fill the property has been reviewed by the Colorado <br />Department of Public Health and Environment and the Tri-County Health Department, <br />both of whom have given valuable input to staff. The state agency must sign off on the <br />permit request before the Board of Adjustment can take action, and this sign off has <br />been completed with comments that the applicant has agreed to implement. Upon the <br />request of the staff, the applicant has produced a traffic study that has been reviewed <br />and approved by the Engineering Division. The Tri-County Health Department has <br />suggested that their agency and the applicant enter into an agreement that will require a <br />periodic inspection of the site by Tri-County to ensure compliance with the state <br />requirements. The City has a similar arrangement with Tri-County Health for the Tower <br />Landfill, and Tri-County also has similar agreements with Adams County and Jefferson <br />County. The reclamation plan for the site refers to the previously approved plan for the <br />entire mined site and is not detailed enough for this site. Since this plan is not adequate <br />and needs to be revised, staff is recommending that the applicant submit a revised <br />reclamation plan for approval before any fill is accepted at the site. <br />DEPARTMENT AND AGENCY REVIEW: The Colorado Department of Public Health <br />and Environment, the Tri-County Health Department, Adams County Planning and <br />members of the City's Development Review Team has reviewed the proposal. <br />Alternatives: The Board of Adjustment has a number of options including approving the <br />request, approving the request with changes, asking the applicant for additional <br />information, or denying the request. <br />RECOMMENDATION: The staff recommends approval of the request with conditions. <br />CONDITIONS: <br />A. The applicant shall operate the filling of the property in compliance with Colorado <br />Department of Public Health and Environment regulations and the plan submitted <br />to the City labeled "Broda's Inert Fill, Revision #1" and any documents referred to <br />in the plan dated October 22, 2002.
