f <br />B. Additions or changes to the plan, as stated in a letter dated March 4, 2003 from <br />Virginia Duffy of the Hazardous Materials and Waste Management Services of the <br />Colorado Department of Public Health and Environment and agreed on by the <br />applicant in a letter of March 5, 2002, shall be included in the operation of the site. <br />(These documents are attached as Exhibit B.) <br />C. No fill will be allowed above the original 5,065-foot flnodplain elevation without <br />further approvals from the City of Commerce City. <br />D. Before any inert fill is received at the site, the applicant shall sign an agreement <br />with the Tri-County Health Department in which they agree to allowing the Tri- <br />County Health Department permission to periodically monitor the site for <br />compliance with the state's solid waste requirements. (A copy of the signed <br />agreement shall be forwarded to the city of Commerce City.) <br />E. The applicant's Reclamation Plan for the site shall be submitted to and approved <br />by the Department of Community Planning and Development Services prior to any <br />filling of the site. <br />AdvisoN: <br />1. The applicant must submit an inert fill application to the City of Commerce City <br />and receive approval of the license prior to any filling of the site. <br />FINDINGS: <br />A. There shall be unnecessary, exceptional, and substantial hardship on the <br />applicant if the zoning ordinance is strictly applied. <br />B. The development or use of the property in question, if held strictly to the zoning <br />standards of the district in which it is located, cannot yield a reasonable return in <br />service, use, or income compared to adjacent conforming property in the same <br />district. <br />C. The Use-by-Permit, if authorized, will neither weaken the general purpose of this <br />chapter nor the requirements prescribed for the district in which the subject <br />property is located. <br />D. The Use-by-Permit, if authorized, will not alter the essential character of the zoned <br />district in which the subject property is located. <br />E.
