City of Commerce City <br />Community Planning and <br />Development Services <br />April 18, 2003 <br />Patrick Broda 337 <br />~ o G a~ <br />Henderson, CO 80640 <br />RE: Case #A-1549-03; 9109 Monaco Street, Commerce City, CO 80022 <br />On Tuesday, April 15, 2003, the Commerce City Board of Adjustment approved your <br />request for aUse-by-Permit at 9109 Monaco Street, subject to the following conditions. <br />Please note those conditions with completion deadlines. <br />A. The applicant shall operate the filling of the property in compliance with Colorado <br />Department of Public Health and Environment regulations and the plan submitted <br />to the City labeled "Broda's Inert Fill, Revision #1" and any documents referred to <br />in the plan dated October 22, 2002. <br />B. Additions or changes to the plan, as stated in a letter dated March 4, 2003 from <br />Virginia Duffy of the Hazardous Materials and Waste Management Services of the <br />Colorado Department of Public Health and Environment and agreed on by the <br />applicant in a letter of March 5, 2002, shall be included in the operation of the site. <br />C. No fill will be allowed above the original 5,065-foot floodplain elevation without <br />further approvals from the City of Commerce City. <br />D. Before any inert fill is received at the site, the applicant shall sign an agreement <br />with the Tri-County Health Department in which they agree to allowing the Tri- <br />County Health Department permission to periodically monitor the site for <br />compliance with the state's solid waste requirements. (A copy of the signed <br />agreement shat! be forwarded to the city of Commerce City. ) <br />E. The applicant's Reclamation Plan for the site shall be submitted to and approved <br />by the Department of Community Planning and Development Services prior fo any <br />filling of the site. <br />F.
