35 <br />The followiog are not categorized as beneficial <br />~ use: the lessee's obligation to conduct <br />reclamation and to maintain mine integrity; the <br />ventilation of non producing areas; the <br />eztraction of slump coal and other actions to <br />prevent fires by ignition of combustible <br />materials or by spontaneous combustion; <br />activities necessary to eztinguish mine fires, <br />to correct hazardous mine conditions, or to <br />dewater mine works; or activities aeceseary to <br />assure the health and safety of the miners or <br />of the public. <br />Casual Uae Activities which do not ordinarily lead to any <br />appreciable disturbance of or damage to lands, <br />resources, or improvements (e.g., surveying). <br />See 43 CFR 3400.0-5(e). <br />Casualties Casualties are accidents or other mishaps which <br />are not forseen and which occur by chance. <br />Because casualties may not be attributable to <br />the lessee, the lessee must ezerciae reasonable <br />care in preventing and reacting to casualties. <br />Economic factors are not considered casualties. <br />Coatinued Operation The production of not less than commercial <br />quantities of recoverable coal reserves in <br />accordance with regulations promulgated to <br />(, implement FCLAA. See 43 CPR 3480.0-5(a)(8) and <br />- 3483.1. <br />Continued Operation Year ;he 12-month period begianing with [he first <br />royalty reporting period following achievement <br />of diligent development for FCLAA coal leases <br />or L!!U's.
