36 <br />.. <br /> <br />FCLAA Coal Federal coal leased on or after August 4, 1916, <br />and subject to FCLAA, as amended, or otherwise <br />made subject to FCLAA's provisions through <br />readjustment, modification, election, or <br />inclusion in an LMU. <br />Federal In these guidelines, refers either to public or <br />acquired lands owned by, or leases issued in <br />the name of, the United States. <br />Federal Lands Either surface or minerals owned by the United <br />States on public domain and acquired lands <br />without regard to method of acquisition or <br />administering Federal Agency. In these <br />guidelines, it refers for the most part to <br />those coal and solid mineral lands owned by the <br />United States sad administered by BLM. <br />Force Majeure Force majeure is a legal phrase taken from <br />French, meaning literally a superior force. <br />For these guidelines it is defined as an <br />uaezpected or uncontrollable event which may <br />ezcuae a party from contractual obligations. <br />Aardrock Minerals 1'hoae locatable minerals for which a mineral <br />patent may be obtained under the Mining Inv of <br />1872 and which are not leasable minerals as <br />defined at 43 CPB 3500.0-5(h) and oil, gas, <br />coal and oil shale or mineral materials <br />disposable under 43 CFR Group 3600. Hardrock <br />minerals include, but are not 1lmited to, <br />copper, lead, zinc, magnesium, nickel, <br />tungsten, gold, silver, bentonite, uranium, <br />barite, feldspar and fluorspar and are leasable <br />on acquired lands. <br />IBLA Interior Board of Land Appeals. <br />LMU Logical Mining IInit (pertains to coal only). <br />Logical Mining IInit An area of land in which the coal resources can <br />be developed in an efficient, economical, and <br />orderly manner as a unit (FCLM, 30 O.S.C. <br />202x). It my consist of one or more Federal <br />coal leases and may include intervening or <br />adjacent leads with no Federal coal (i.e., <br />Indian, private/fee, and/or State). <br />Lease Month Por the purposes of these guidelines means <br />calendar month. <br />Attachment 1-39 <br />
