• 29 <br />1. Termination of Suapenslons. <br />The coal or solid mineral lease or IMT suspension rill be terminated <br />by decision of the authorized officer, subject to appeal, for any of <br />~ the reasons listed above. A suspension may also be terminated either <br />rhea the lessee notifies the authorized officer of resumption of <br />beneficial wee of the lease or the justification for the lease <br />suspension ceases. <br />For auapenaion termination, the authorized officer viii issue a <br />decision, subject to appeal, clearly stating the reason(s) for <br />terminating the coal or solid mineral lease or LMU auapenaion prior to <br />ezpiration of its approved period. Action taken to terminate a <br />auapenaion must be adequately supported by information is the case <br />file. This information shall consist of the inspection reports or the <br />lessee's notification that beneficial use of the lease(s) has <br />resumed. In addition to the reasons for termination, the decision <br />shall include the following information: <br />' The effective date of suspension termination; <br />' The date upon which the applicable suspended lease terms and other <br />requirements recommence; <br />' 'She date upon which the applicable a:tended lease terms and other <br />requirements recommence; <br />_ Tha lease terms and conditions that were not extended; <br />( • Por FCLM coal leases or for I24U's Chat promo aced coal vhile wader <br />_. a force majeure suapeaeion, specify the amount of production to be <br />credited toward tae lC-year diligent deve'_op.es[ or eoat'_sued <br />operation year requirements; <br />° For FCLM coal leases or for INU's, specify the production <br />required to achieve diligent development for the remainder of the <br />10-year diligent development period (for force majeure <br />suspensions) or to maintain continued operation for the remainder <br />of the continued operation year, Sf applicable; and <br />' For non-FCLM coal lessen and solid mineral leases, specify any <br />proportionate reduction of minimum annual production/ainimum <br />royalty requlremeata for that portion of a lease year during which <br />a suapeaeion was in effect. <br />•• Update both AI14tS and SI1iS regarding auapenaion termination. <br />For SLMS, particular attention Host De focused on changing <br />dates resulting from lease terms being affected by the <br />auapenaion or, if applicable, by the aubaequent ertenaion, <br />especially the nezt readjustment or renewal due dates. <br />Fot non-FCLAA coal, the first, poet-FCL4A coal lease readjustment <br />anniversary date is not eztended by any of the three suspeneione. <br />For PCL4A coal leases and for I?N'a, enter new beginning date for <br />continued operation year.
