<br />• 30 <br />2. Fapiration of Suspensions. <br />Iihere a coal or solid mineral lease, or I?N, suspension espires under <br />its own terms, the authorized officer will issue a decision stating <br />that the suspension has expired. The decision will include the <br />following information: <br />' The effective date of suspension ezpiration; <br />° The date upon xhich the applicable suspended lease terms and other <br />requirements recommence; <br />' The date upon which the applicable eztended lease terns sad other <br />requirements recommence; <br />° The lease terms and other requirements that were not eztended; <br />' Any rental or minimum royalty credits that resulted fros the <br />suspension; <br />' For FCLAA coal leases or for IMI's that produced coal while under <br />a force majeure suspension, specify the amount of production to be <br />credited toward the 10-year diligent development or continued <br />operation year requirements; <br />° For FCLAA coal leases or for IMT'a, specify the production <br />required to achieve diligent development for the remainder of the <br />10-year diligent development period (for force majeure <br />suspensions) or to maintain continued operation, if applicable, <br />for the remainder of the continued operation year; and <br />' For non-FCL~,A coal leases and solid mineral leases. specify nay <br />proportionate reduction of minimum annual production/sinimus <br />royalty requirements for that portion of a lease year during which <br />a suspension was in effect. <br />A decision providing notice of ezpiratioa is not subject to appeal sad <br />does not require an appeals paragraph. <br />•• Opdate both AI?QtS and SI1iS regarding suspension ezpiration. <br />For SI?!S, particular attention must be focused on changing <br />dates resulting fros lease terms being affected by the <br />suspension or, if applicable, by the subsequent ertension, <br />especially the nett readjustment or renewal due dates. Por <br />FCI.A11 coal leases and for 11l0's, enter changes fos the nex <br />beginning date for continued operation year and, for I?IO's, <br />the new end date of the 40-year sine out. <br />3. Copies to Other Offices. <br />Copies of decisions terminating a suspension or providing notice of <br />e:piretion of the suspension period and resumption of lease terms will <br />be sent to the appropriate BI14 M strict or Area Office, as applicable, <br />and to any Federal Agency that was consulted during the decision <br />process. FMS shall be sent a copy of all decisions affecting rental, <br />royalty, or production requirements. <br /> <br />Attachment 1-33 <br />
