28 <br />D. Monitoring Aa Approved Suapensioa. <br />Upon approval of any of the three types of suspensions discussed in these <br />guidellnea, the authorized officer will increase the number of scheduled <br />inspections of the suspended coal or solid mineral lease or 12SfJ. Such <br />inapectiona will be conducted more often Chan quarterly by the office <br />responsible for lease lnapection and enforcement. Fach Inspection rill <br />determine whether the condition, situation, or event upon which the suepenaion <br />was premised has changed. Additionally, where beneficial use of the lease or <br />' IltU fa dented, the inspection must ensure that such use has not resumed. <br />Beneficial use of the lease or IMI is only permitted under a Eorce majeure <br />auapension. <br />It may be appropriate, depending on [he mining operation and the type of <br />suepenaion, to coordinate the lease inspections with other Pederal Agencies <br />such ae the surface management agency, if other than BIJ1, and for coal <br />OSMtE/SRA. For force majeure suspensions, the production reports submitted to <br />FWS will be closely monitored. Any anomalous production noted from one <br />reporting period to another must be evaluated. If the produetloo rate during <br />the force majeure suepenaion period is sufficient to achieve or ezceeda the <br />pre-auapension rate production requirements, the suspension shall be <br />terminated. <br />*• Update SI2LS inspection-related data elements. <br />C. Ter~isetion or Fs pi-ation of Suspensions. <br />A coal or solid mineral lease or IMi auapension may end for one of the <br />folloxing reasons, if applicable to that suepenaion type: <br />Beneficial use of the lease or IM1 recommences; <br />Zbe conditlon,.situation, or event that provided justification for the <br />auapeasion ceases; <br />Zhe annual recertification justifying the continuing need for a <br />auapension is due. but has not been filed by the lessee; <br />Production reaches the pre-auapension rate or is sufficient to achieve <br />pre-auapension production requirements (for force majeure suspensions <br />only); or <br />the approved suepenaion period ezpiree. <br />Attachment 1-31 <br />
