Application for Eztension. 4lttere it is anticipated that the <br />conditions, situation, or events which are the basis for a coal or <br />solid mineral lease suspension will continue beyond the approved <br />suapeasioa period, the lessee must apply, prior to the ezpiration <br />of the existing suspension for an ezteasion. If granted, the <br />ezteasion becomes effective ae of the ezpiration date of the <br />current period. The application should provide sufficient <br />information, in conformance with statutory and regulatory <br />requirements as well as with these guidelines, to establish that <br />the suspenaioa should continue. <br />Aa application for an ezteasion of a auspensioa of operations for <br />a coal lease sot subject to FCLAA shall not be granted since it is <br />limited by statute to 6 months at a time. The lessee must file a <br />new application requesting another suspension of operations. For <br />just cause, the authorized officer may agree to another suspension <br />of operations for a coal lease not subject to FCLAA. Another <br />suspension of operations mould become effective upon termination <br />of the existing, approved suspension of operations. <br />An application for an ezteasion of any type of suspension that has <br />been terminated by the authorized officer cannot be accepted. If <br />there is a continuing seed for a suspension, the lessee must file <br />a new application for consideration by the authorized officer. <br />However, nothing prevents the new, approved suspension from being <br />retroactively effective to the termination date of the previous <br />suspension if the authorized officer de[e-m1*_es that another <br />suspension is warranted. <br />c. Proprietary/Confidential Information. Financial or other <br />information which is proprietary or confidential (either paper <br />documents or ADP data) and which is submitted by a lessee in <br />support of nn application for a suspension shall be handled as <br />required by regulations and in accordance with Blli lSanual 1273, <br />entitled "Security". <br />2. Application Filing. <br />An application is considered filed as of the date of receipt in the <br />BLl1 State Office. If the application ie hand-delivered, the <br />authorized officer will ensure that the application is date- and <br />time-stamped by the receiver.
