t <br />zo <br />Suspension Termination or Expiration. A force majeure suspension ends on: <br />1. The date the actuation or conditions causing the interruption of <br />operations or production ceases; <br />2. The date that production reaches the pre-suspension rate; <br />3. The date that annual recertification of continuing conditions is due <br />but has not been filed by the lessee; or <br />4. The expiration of the approved suspension period, whichever occurs <br />first. <br />Suspended lease terms and conditions are once again in full force and effect <br />as of the date the suspension terminates or ezpires. <br />For coal leases not subject to FCLAA, the minimum production/minimum royalty <br />requirement resumes on the first day of the lease month during which <br />operations or production resumes. For FCLAA coal leases sad for I2iU's, the <br />eztension of lease terms and other requirements begins on the date of force <br />majeure suspension and continues for a period of time equal to the total <br />period that the lease was suspended. For solid minerals, the suspension of <br />minimum royalty payments ends on the firaL day of the lease month during which <br />operations or production is resumed or upon ezpiration of the force majeure <br />auapenaion, whichever occurs first. <br />Dnder a force majeure auapenaion, the lessee is relieved of the production <br />obligation but may continue operations or production. 8owever, production at <br />the pre-auapenaion rate or to the degree necessary to achieve pre-force <br />majeure suspension production requirements will terminate the suspension. <br />SECTION II. ADNINISTRATIYE PROCEDURES <br />This section of the guidelines discusses general adminlatrative procedures, <br />giving basic guideace from application processing to subsequent termination or <br />ezpiration actions applicable to all the following types of auapeasions: <br />Suapeasiona of operations and production (Section I.A., page 2); <br />Suspensions of operations (Section I.B., page 9); and <br />° Porce majeure suapenaiona (Section I.C., page 14). <br />Suspension-specific information previously provided in the guidelines is not <br />repeated here, eo Section II moat be used is conjunction with Section I in <br />order to obtain necessary information regarding whether a suspension may be <br />granted and how each type of approved auapenaion gill affect a coal or solid <br />mineral lease of I2N. The statutory basis and regulations pertaining to each <br />type of suspension for coal or solid mineral leases and IM1's are discussed in <br />Section I of these guidelines. <br />i <br />~~,. <br />Attachment 1-23 <br />
