19 <br />~ Terms and Conditions Not Extended. The following lease terms and <br />~ conditions are not eztended for non-FCLAA coal leases and solid mineral leases: <br />° Lease term; <br />° Lease readjustment or renewal dates; sad <br />1 MI1. Section 2(a)(2)(A) 10-year holding and producing coal in <br />commercial quantities perlod. (Non-FCLAA coal leases only) <br />For FCLAA coal leases and LMU's, the following lease terms and other <br />requirements are not eztended: <br />° Lease term; and <br />° Lease readjustment date. <br />b. Effective Date and Duration of Suspension Period. <br />Effective Date. The authorized officer specifies the effective date of a <br />Force majeure suspension. Since the lessee is not denied beneficial use of <br />the lease during a force mejeure suspension, beneficial use is not a factor in <br />establishing the effective date. The effective date of a force majeure suspen- <br />sion may be specified, therefore, as the date that the strikes, elements or <br />casualties causing interruption of operations or production occurred or as of <br />the date that an acceptable application is filed. Where a suspension is based <br />upon the commencement of force majeure events, the effective date of the force <br />oajeure suspension may predate the application (i.e., the authorized officer <br />oay establish a retroactive effective date as well as a retroactive duratlon <br />for the suspension). The suspension of applicable lease terms and conditions <br />begins on the day that the auspenaion becomes or became effective. <br />For non-FCLAA coal and solid minerals, the suspension of minimum <br />production/minimum royalty will begin either with the firer day of the lease <br />oonth during which the force majeure auepension becomes effective or, if the <br />effective date of the force majeure auepension and the first day of the lease <br />month do not coincide, with the first day of the lease month following the <br />effective date of the force majeure suspension. <br />Suspension Duration. A force majeure auspenaion shall be approved for <br />the expected duration of the situation causing the interruption of operations <br />or production. <br />If a force majeure auspenaion is approved for a period exceeding 1 year, the <br />lessee must certify prior to the end of each successive 12-month period <br />following the effective date of the suapenaioa that the conditions upon which <br />the force majeure auspenaion wan justified continue. The requirement for <br />lessee-recertification ensures periodic review of the situation or conditions <br />under which the force majeure suspension was granted.
