Terms and Conditions Suspended for FCLAA Coal Leases and LMJ's: <br />Diligent development (provided production has commenced); <br />Continued operation and payment of advance royalty in lieu of <br />continued operation; <br />MLA Section 2(a)(2)(A) producing coal in commercial quantities <br />requirement; and <br />° lII.A Section 2(d) LMT 40-year mine-out requirement. <br />Aay production achieved on a lease or LMI during the effective period of a <br />force majeure suspension shall be credited toward the lease or LMJ diligent <br />development or maintenance of Che continued operation requirements upon the <br />termination or ezpiration of the force majeure suspension. 9ny production <br />achieved during the force majeure suspension period shall not be used to <br />decrease the commercial quantities tonnage upon which the diligent development <br />and continued operation requirements are based. <br />Terms and Conditione Not Suspended. For all coal and solid mineral <br />leases, the following lease terms and other requirements are not suspended <br />during the effective period of a force majeure suspension: <br />° Deferred bonus payment; <br />° Rental; <br />° Royalty payment for coal or solid minerals mined or Bold during the <br />force majeure suspension; <br />° Beneficial use of the Iease; <br />Reclamation requirements; <br />° Miae~aintenance requirements; and <br />° Public and mine personnel health and safety requirements. <br />?erns and Conditione Eztended. The following lease terms and conditions <br />are eztended by an amount of time equal to the duration of a force majeure <br />suspension for non-PCLAA coal sad solid mineral lessee: <br />° None <br />For FCLAA coal leases and for LMT's, the following lease terms and other <br />requirements are ertended: <br />MLA Section 7(a) 10-year period (provided production has commenced); <br />° MId Section 2(d) LMT 40-year period; <br />MLA Section 7(b) annual continued operation period; sad <br />° MId Section 2(a)(2)(A) 10-year holding period. <br />Attachment 1-21 <br />
