1 <br />i 17 <br />A BLM, MSHA, and OSMRE/SRA enforcement order for cessation of operations as a <br />result of violations attributable to the lessee (or operator) !s not grounds <br />for a force majeure suspension. A BLM, MSNA, OSMRE/SRA enforcement order for <br />cessation of operations as a result of nonviolation conditions may be grounds <br />for a force majeure suspension if: 1) the conditions which prompted the <br />1 cessation are not attributable to the lessee's (or the operator's) actions or <br />inactions; and 2) if the application otherwise meets the requirements for <br />approval of a force majeure suspension. <br />The basis for a force majeure suspension application may be casualties which <br />interrupt a lessee's operations or production but which happen to another <br />party over whom the lessee has no control. Such an application will require <br />documentation from that party regarding the casualties as well as a statement <br />fros the lessee on the resulting disruption of operations of production. <br />3. Effects of a Force Hajeure Suspension Oa Lea <br />Requirements. <br />A force majeure suspension relieves the lessee of production obligations under <br />the lease when Lease operations are interrupted by strikes, the elements or <br />casualties not attributable to the lessee. <br />a. Specific Terms and Other Requirements Affected. <br />Terms and Conditions Suspended. The following lease terms and conditions <br />are suspended during the effective period of an approved force majeure <br />1 '. suspension: <br />~. <br />1. Terms and Conditions Suspended for Solid Mineral Leases: <br />° Minimum production requirement; and <br />° Minimum royalty payments Sn lieu of production. <br />2. Terms and Conditions Suspended for non-FCLAA Coal Leases: <br />° Minimum production requirement; <br />° Minimum royalty payments in lieu of production; <br />° Lease-specific diligent development requirements; <br />Lease-specific continued operation requirements; and <br />° Advance royalty payments in lieu of continued operation, if lease <br />terms eo allow. <br />~.~ <br />Attachment 1-20 <br />
