I. Upon the success and viability of the mitigation as determined by the Corps of Engineers, a Long-term <br />Mitigafion Success Report will be submitted to the Denver Regulatory Office every five years starting in 2010 <br />and continuing until the. end of the mining project to ensure the long-term management and protection of the <br />permanent mitigation. The reports will be submitted to the Denver Regulatory Office before December 31 of the <br />yeazs 2010, 2015; 2020, and 2025. These reports will include but not be limited to: <br />I.1. permit number and county where the project is located; <br />I.2. a brief discussion of the mining activities schedule <br />L3. a discussion of successes, failures, or problems at the mitigation sites; <br />I.4. photographs of mitigation area (to be taken from the same location and submitted with each report). <br />L5. If the site conditions indicate that the mitigated wetlands aze failing, perhaps due to inadequate hydrology or <br />hydrology affected by the mining, a remedial action plan will be required to supply adequate hydrology. <br />1.6. The last report in 2025 should confirm that willows have been planted at that time, which is required to take <br />place during the reclamation of ce114 (as mentioned in special condition F). <br />J. The Colorado Department of Health issued Section 401 Water Quality Certification Number 3074 on September 8, <br />2003, in accordance with Section 401 of the Ciean Water Act. The permittee agrees to comply with Certification <br />Number 3074, the requirements from which aze attached to, and made a part of, this permit. The water quality <br />certification is shown on Attachment 5. <br />The following special conditions are related to the responsibilities of the landowner regarding preservation of the long-term <br />preservation of mitigation wetlands and other casting wetlands on the property. <br />P. The pemuttee (Landowner) is responsible for the long-term preservation of the created wetlands on the property for <br />years beyond the mining activities. The attached deed restriction (Attachment 4), which describes and ensures <br />protection of the wetlands on the property, will be agreed to and implemented upon issuance of this permit. <br />Q. Cattle grazing will cease in all wetland mitigation azeas after the mining of ce114. This includes all newly <br />created wetlands, preserved wetlands, and willow plantings along the Big Thompson River. <br />R Based on information provided by the applicant, the Corps has determined the basic project purpose to be <br />aggregate mining. This project purpose was the basis upon which the Corps conducted its review of the <br />application, as well as a basis for the Corps' determination that permit issuance is in the best interest of the <br />public. Accordingly, the Corps authorizes no change in project purpose, or in the nature of the permitted <br />activity, without prior review and approval. One specific example would be conversion of the aggregate mine <br />pits to storage of municipal and{or industrial water. <br />After a detailed and careful review of all of the conditions contained in this permit, the permittees acknowledge <br />that, although said conditions were required by the Corps of Engineers, nonetheless the permittees agreed to those <br />conditions voluntarily to facilitate issuance of the permit; the permittees will comply fully with all the terms of all <br />the permit conditions. <br /> <br />11, Determinations. <br />The Corps has reviewed and evaluated this project in light of the relevant public interest factors and the stated <br />views of other interested agencies and the concerned public.
