effects of the project in accordance with regulations published in 33 CFR Part 320 and 40 CFR Part 230. The <br />following paragraphs summarize the results of the evaluation and how the project complies with the above-cited <br />regulations. <br />11.1 Findings of No Significant Impact [33 CFR 325.2(a)(4)]. <br />Having reviewed the information provided by the applicant and other interested parties and the assessment of all <br />environmental impacts contained in this decision document, I find that this permit action will not have a <br />significant impact on the quality of the human environment. Therefore, an environmental impact statement is not <br />required. <br />11.2 Sectiou 404(6)(1) Guidelines [40 CFR Part 230]. <br />The work was evaluated pursuant to the Guidelines. It was determined that there are no available practicable <br />alternatives having less adverse impact on the aquatic ecosystem and without other significant adverse <br />environmental consequences that do not involve discharges into waters of the United States or at other locations <br />within these waters. In addition, the discharge will not violate state water quality standards or toxic effluent <br />standards, the discharge will not jeopazdize any endangered and/or threatened species or their critical habitat, nor <br />will the dischazge contribute to significant degradation of waters of the United States. I have determined that the <br />project complies with the Guidelines with inclusion of appropriate and practicable conditions discussed in this <br />document to minimize pollution or adverse effects to the aquatic ecosystem. The Section 404(6)(1) Guidelines list <br />can be found on Attachment 7. <br />11.3 Public Hearing. <br />No public hearing was requested or held for this project. <br />11.4 Clean Air Act. <br />The proposed project has been analyzed for conformity applicability pursuant to regulations implementing Section <br />176(c) of the Clean Air Act. It has been determined that the activities proposed under this permit will not exceed <br />de minimis levels of direct emissions of a criteria pollutant or its precursors and aze exempted by 40 CFR Part <br />93.153. Any later indirect emissions are generally not within the Corps continuing program responsibility and <br />generally cannot be practicably controlled by the Corps. For these reasons a conformity determinafion is not <br />required for this permit. <br />11.5 Public Interest (33 CFR Part 320.4]. <br />I have determined that issuance of a Department of the Army permit with conditions is not contrary to the public <br />interest. <br />Project: Gtern & Croissant Aggregate Mining Applicant: Loveland Ready Mix, Inc.
