the oxbow channel wetlands, the applicant proposes to create 3.50 acres of relocated oxbow channel wetlands on <br />the project site, and 3.55 acres of wet meadow wetlands on the project site, totaling 7.05 acre of created mitigation <br />wetlands. <br />9. Environmental AssessmentlNEPA. <br />This decision document constitutes the Department of the Army, Corps of Engineers (Corps) Environmental <br />Assessment, Statement of Findings, Public Interest Review, and compliance determination under the National <br />Environmental Policy Act (NEPA). The review was conducted in accordance with procedures described at 33 <br />CFR Part 320 and Part 325, including Appendices B and C. This document also addresses the requirements <br />contained in the Environmental Protection Agency's Section 404(b)(1) Guidelines published at 40 CFR Part 230. <br />10. Permit Conditions. <br />The following conditions will be added to the permit. Each permit condition was reviewed for enforceability. <br />conclude that each permit condition is reasonably enforceable and fully implementable. There was some <br />controversy regarding who should be the actual "permittee" of this action...Loveland Ready Mix, or the <br />Landowner...or both. The Corps decided that both parties should be on the permit since the landowner is <br />ultimately responsible for the long-term protection of the mitigation areas after mining. See a-mail discussions <br />between Tim Cazey, Chief of Denver Regulatory Office, and Mr. Michael Savage, Loveland Ready Mix's <br />consultant, attached to this file. <br />:~:.»:**•***r•rrsr+*s*r**ss***r*+**srr**r***s****a•~*r*s-*r*~s*+***r:*t*sr**arr***:::.*s <br />SPECIAL CONDITIONS <br />Both parties agreeing to this permit aze responsible for the activities taking place on the ]and, however, it is understood <br />that Love]and Ready Mix is responsible for wetland impacts related to gravel mining and the construction and success of <br />mitigation wetlands as proposed in the permit application, Viola C. Croissant /Leon H. Croissant Family Trust, the <br />current landowner, or any future landowners, aze responsible for agreeing to the deed restriction placed on the property <br />regarding the long term preservation of mitigation wetlands and other existing wetlands on the property. The special <br />conditions aze sepazated to clarify those separate responsibilities. <br />The following special conditions are related to the responsibilities of Loveland Ready Mix, Inc. regarding wetland <br />impacts related to gravel mining activities and the construction and success of the mitigation wetlands: <br />A.
