14, Specific approvals have been granted These approvals are addressed in <br />the following section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species or <br />result in the destruction or adverse modification of their critical <br />habitats. See page 2.05.18 of the permit application for this <br />information. (2.07.6 (2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, Juty 26, 1988, the operator is current in the <br />payment of reclamation fees required by 30 CFR Chapter VII, subchapter R. <br />(2.07.6 (2 ) (0) ). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4 <br />I. Roads - Rule 4.03 <br />The Division proposes to approve the retention of a portion of the <br />haul road and the access road which lead to the office area <br />(depicted on Map No. 10) since it is compatible with the approved <br />postanining land use, and a request for its retention was submitted <br />by the landowner. The office and garage will remain after the <br />loadout has been reclaimed. These structures will be converted to <br />a residence and garage following reclamation and retention of the <br />roads are required to provide access. In addition, this roadway <br />will provide access for two adjacent landowners since Delta County <br />is planning to abandon County Road 4365. Information pertaining to <br />roads can be found on pages 2.05-5R and 2.05-9, and Maps 5 and 9. <br />The haul/access road at the loadout connects the facilities with <br />State Highway 133. The roadway is approximately 400 feet long and <br />24 feet wide. Road cross-section and profile drawings are <br />presented on Map 9. The location of road drainage ditches and <br />culverts is provided on Map 5. Terror Creek has obtained a Permit <br />for Access from the State Highway Department for the highway <br />approach and a License Agreement with the Bureau of Reclamation and <br />the Fire Mountain Canal Company to allow construction of a concrete <br />box culvert across the Fire Mountain Canal. (4.03.1 (1)(f)(i)), <br />II. Surface and Ground Water Monitoring-Rule 4.05 <br />1. The applicant will conduct monitoring of surface water in a manner <br />approved by the Division. The monitoring plan was submitted under <br />2.05.6(3)(b)(iii) and includes the following. Discharge from NPDES <br />discharge points 001 and 002 will be sampled monthly and analyzed <br />for pH, flow, total suspended solids, total iron, total dissolved <br />solids, and of ] and grease.
