The Division will also have concerns about the type of disturbance that <br />could occur. For example, if drilling and blasting are to occur, and if a <br />highwall will exist, our concerns will be primarily focused on any potential <br />public safety problems the disturbance may pose to the nearby mad. We <br />will also be concerned with potential reclamation problems, given the need <br />for possible cut-and-fill work between the crest of the highwall and the mad. <br />Additionally, Rule 2.05.3(c)(v)(A) states: <br />"Each applicarion shall contain a detailed description of the specific mining <br />operations proposed to be conducted within the permit area. This description <br />shall include: <br />(3)(c) A description of each road, conveyor, or rail system to be constructed, <br />used or maintained within the proposed permit area. The description <br />shall include...thefollowing: <br />(v) A description of measures to be used to ensure that the <br />interests of the public and landowners affected are <br />protected if, under 2.07.6(2)(d)(iv), the applicant <br />seeks to have the Division approve.• <br />(A) Conducting the proposed surface mining activities <br />x~thin 100 feet of the right-of--way line of any <br />public road... " <br />2. A question arose regarding the necessity of permitting (a) an existing farm <br />shop owned by Western Fuels that will be converted to a warehouse to store <br />mining equipment, (b) a new shop to be constructed, and (c) a new bath <br />house to be constructed. <br />All of these structures need to be permitted per Rule 1.04(132)(b), which <br />states: <br />"(132) 'Surface coal mining operations' means: <br />(b) The areas upon which such activities occur or where such <br />acrivities disturb the natural land surface. Such areas <br />shall also include any adjacent land the use of which is <br />incidental to any such activates... " <br />3. A third question arose regarding the amount of material minimally neces- <br />sary to initiate the Permit Renewal process. This information is available in <br />Rule 2.08.5(2), "Applications for Permit Renewals." <br />
