Lang <br />Division Director <br />Thank you for your facsimile of September 12, 1992 and your follow-up telephone call <br />on the 17th. I'd like to reiterate your concerns and provide our responses. <br />1. A question was raised regazding the legally allowable proximity to a public <br />road of both a permit boundary and actual affected land. <br />Rule 2.05.6(2) describes ceri~~-.criteria for permit approval or denial. The <br />rule states: <br />"(2J No permit or revision applicarion shall be approved unless the <br />application affirmatively demonstrates and the Board or Division <br />finds... that: <br />(d) The proposed permit area is: <br />(ivJ Not within 100 feet, measured horizontally, <br />of the outside right-of--way line of any <br />public road if the Board or Division... " <br />The rule then goes on to discuss what items and procedures are required for <br />this exemption. As the rule specifically refers to "permit area," both the <br />permit boundary and the affected area boundary must comply with this <br />provision. <br />
