Stinulation No. 2 <br />The applicant shall continue to submit to the Division an annual report of inflows, discharges and <br />consumption of water within the mine. This report is t o include a mine workings map showing the location <br />and quantity of inIIows, a table keyed to the mine map which shall contain the source (i.e., Fault, fractures, <br />etc.), Quantity, duration, and quality (i.e. pH, electro-conductivity and temperature) of all inflows, a table <br />containing records of water dischazged from the mine, consumed in the mine, and imported for use within <br />the mine, a map showing cun•ent water uses, a discussion of the water balance within the mine, and finally <br />a projection of hydrologic impacts of mining in the upcoming yeaz. This shall be submitted no later than <br />April 30 of each yeaz, included with the AHR <br />The commitment to provide all of the above information is contained within the permit. Mine water <br />consumption data is part of the mine water balance included in each AHR <br />One minor change to the stipulation was made. With the approval of Technical Revision No. 54, fire due <br />date of the Annual Hydrologic Report (AHR) was changed to Apri130 of each yeaz. The above information <br />is submitted with the AHR <br />STATUS: Terminated August 5, 1993 <br />Stinulation No. 3 <br />The operator shall, upon closure, install water-tight seals within the mine to prevent gravity dischazge. This <br />requirement may be waived upon the Division's approval of a plan submitted by fire operator. This plan <br />shall include a demonstration that the water quality of the dischazge from the mine workings will be of <br />acceptable quality and will remain acceptable after mine closure. This shall include chemical analysis and a <br />predictive model that uses oxidation and reduction potential to determine regulations of the State Engineer's <br />office. Finally, parts of the stipulation address how to seal wells, and aze included in our regulations. <br />STATUS: Future <br />Stipulation No. 4 <br />When the applicant submits a permit application to undermine the Dry Fork of Minnesota Creek, the <br />subsidence protection plan shall be based upon monitoring information collected during the eazlier phases <br />of mining. <br />STATUS: Terminated November 30, 1992. <br />Stipulation No. 5 <br />Following stockpiling, topsoil stockpiles that will not be redistributed for five or more years shall be seeded <br />with the proposed permanent seed mix (excluding shrubs) and not the temporary mix. <br />STATUS: Terminated November 30, 1992. <br />Stinulation No. 6 <br />The Division dvects Mountain Coal Company, prior to any disturbance at the upper waste pile site, to <br />submit an appropriate amendment to the operation plan within the existing permit to limit extraction <br />beneath the waste pile and within a defined buffer zone to primary development only. The surface buffer <br />zone will be defined by the subsidence angle of draw. <br />STATUS: Forgiven August 5, 1993 <br />
