Sfioulation No. 7 <br />The Division directs Mountain Coal Company, prior to any disturbance at the upper waste site, to install <br />several electronic tiltmeter tubes downslope from the toe of the proposed waste structure. These tilt meter <br />installations shall be installed as specified in MCC's August 15, 1985 submittal. One indicator shall be <br />installed within 160 feet of the toe of the waste pile currently halfway between monuments 51 and 54. The <br />second shall be listed appropriately 100 feet northeast of monument S2, 160 feet north of toes of the <br />wastepile, as indicated on drawing No. MG-R C-0Ol, included in the permit revision No. 6 application. <br />During the installation of these tiltme[er robes, the operator shall auger and log the surficial and bedrock <br />stratigraphy encountered. Augering shall continue until the operator has established intact bedrock <br />occurrence. If any evidence of existing landslide deposits is encountered, the operator shall define the <br />nature and extent of the pre-existing slope instability. If such landslide activity is discerned, the operator <br />will be required to appropriately reco~gure the pile design, prior to initiation of any construction activity. <br />STATUS: Future <br />Stipulation No. 8 <br />Surface water and groundwater monitoring of the lower permanent underground development waste pile <br />will include the chemical constituents selenium, un-ionized ammonia, and nnate/nitrite. Determination of <br />nitrite concentration will be made only when deemed necessary by the Division. Results and <br />interpretations are to be included on a continuing basis in the West Elk Coal Company quarterly hydrology <br />reports. Aanual hydrology reports are to include a summary of seasonal changes, if any, for all chemical <br />constituents (surface and goundwater) monitored during the year. Annual hydrology reports aze to include <br />an assessment of the impacts of the lower waste pile to the hydrologic balance during the previous year. <br />STATUS: Terminated November 30, 1992, <br />Stipulation No. 9 <br />Annual hydrology reports aze to include, pursuant to rule 2.04.7 (1)(B), a map showing the piezometric <br />surface of the colluvial aquifer in the area of the lower perntanent underground development waste pile, if <br />one develops. <br />STATUS: Terminated May 28, 1992. <br />Stipulation No. 10 <br />The Division directs Mountain Coat Company to complete a thorough reconnaissance geologic mapping of <br />the proposed upper waste pile access road corridor. The applicant shall place specific emphasis upon the <br />detection of slope instability evidence and drainage chazacteristics of the proposed road alignment. <br />STATUS: Temtinated May 28, 1992. <br />Stipulation No. 11 <br />The Division directs Mountain Coal Company to construct the upper waste pile access road as an initial <br />pioneer road with minimized excavation. Upon exposure of the excavated cut-slopes of that pioneer <br />roadway, the operator shall complete a final geotechnical investigation of the access road corridor. This <br />geotechnical investigation shall be completed by appropriately qualified professional geological or <br />engineering personnel. The purpose of this final investigation shall be to verify, or appropriately amend, <br />the findings of the reconnaissance geologic mapping of the roadway corridor. <br />Further, Mountain Coa] Company, utilizing fhe findings of the final geotechnical investigation, shall <br />compiete a final engineered cut-slope and drainage design for the upper waste pile access road.
