Stipulation No. 64 <br />The Division approves minor revision No. 221 as a temporary measure to ensure that the Sylvester Gulch <br />channel remains open to convey flow. The Division directs Mountain Coal Company to submit a proposed <br />design for rehabilitation of the Sylvester Gulch stream channel. This submittal should be in the forth of an <br />appropriate revision submitted to the Division no later than September 30, 1997. The revision should <br />address the channel configuration during both the operational and reclauned phases. <br />STATUS: Complied with December 5, 1997. <br />Stipulation No. 65 <br />The Division specifically does not approve additional disturbance to the Sylvester Gulch stream channel as <br />a result of the temporary pipe installation. The Division directs Mountain Coal Company to place the pipe <br />onto the channel bottom without excavation in or near the stream and without constructing a corridor for <br />the pipe as originally proposed in MCC's minor revision no. 221 application dated July 11, 1997. <br />STATUS: Complied with August 9, 1997. <br />Stipulation No. 66 <br />The applicant must not discharge any water from the driilholes or piezometers proposed for installation <br />with minor revision application no. 226 until all necessary approvals and/or permits have been obtained <br />from the Colorado Department of Public Health and Enduonment, Water Quality Control Division <br />(WQCD.) The Division is approving the installation of twelve (12) boreholes /piezometers. Once the <br />necessary approvals have been obtained from WQCD, the Division will approve discharge of groundwater <br />to an existing sedimentation pond. <br />STATUS: Complied with October 8, 1997. <br />Stipulation No. 67 <br />Within 60 days of approval of MR-225 MCC must submit revised models for Pond MB-2R. the revised <br />models must reflect the additional disturbed azea which will result from the construction of the water tack <br />topsoil pile. The revised models must be submitted as a minor revision to the permit and must be received <br />by December 20, 1997. <br />STATUS: Complied with by submittal of MR-235 on February 2, 1998. <br />Simulation No. 68 <br />Within 90 days of construction of the subsurface drainage structures proposed in minor revision no. 239, <br />MCC shall submit designs for the pond MB-I surface drainage system which include flow from the <br />subsurface drainage system. <br />STATUS: Complied with May 13, 1999. <br />Stipulation No. 69 <br />Within fifteen days of consummation of the transfer of the West Elk Mine permit from Mountain Coal <br />Company to Mountain Coal Company, LLC, the Division shall be provided with documentation that all <br />necessary rights of entry, as required by section 2.03.6, have been transferred to Mountain Coal Company, <br />LLC. <br />STATUS: Complied with July 2, 1998 <br />15 <br />
