Stipulation No. 57 <br />With submittal of permit revision no. 6, Mountain Coal Company has removed all permit document <br />references to mining beneath the Dry Fork of Minnesota Creek intermountain diversion and reservoir <br />system, including references to buffer azeas and associated subsidence control plans. Previously approved <br />subsidence control plan documents aze maintained within the Division's files. <br />The Division has not, and will not, approve any mining which will potentially affect the Dry Fork of <br />Minnesota Creek intermountain diversion and reservoir system, including all previously designated buffer <br />azeas, until an appropriate subsidence control plan is submitted and approved. <br />STATUS: Future <br />Stipulation No. 58 <br />Mountain Coal Company will not initiate disturbance or drilling at exploration Hole II until a minor <br />revision is submitted and approved which provides U.S. Forest Service approval and U.S. Fish and Wildlife <br />Service concurrence for access to and drilling at Exploration Hole II. <br />STATUS: Complied with. <br />Stipulation No. 59 <br />Mountain Coal Company will continue to work with the Division to finalize an appropriate bond amount in <br />a timely manner. Bond amount fmalization will proceed in accordance with the requirements of 3.02.2(4), <br />STATUS: Complied with October 1, 1996. <br />Stipulation No. 60 <br />Mountain Coal company will submit a revised Exhibit S I Figure 2.0 G (or equivalent figure) to accurately <br />depict lower refuse pile -topsoil pile locations and volumes, no later than December 31, 1996. <br />STATUS: Complied with by submission of Minor Revision 204, January 2, 1997. <br />Simulation No. 61 <br />The disturbance proposed for Permit Revision No. 7 shall not begin until the Division has received United <br />States Fish and wildlife Service concurrence for this project. <br />STATUS: Complied with May 30, ]997. <br />Stipulation No. 62 <br />Mountain Coal Company shall provide documentation which verifies that the United States Forest Service <br />does not manage any lands within the proposed disturbed area associated with permit revision no. 7. <br />STATUS: Complied with May 12, 1997. <br />Stipulation No. 63 <br />Disturbance associated with Technical Revision No. 79, which is proposed to occur within 100 feet of the <br />highway right-of--way, shall not occur until the Division has received documentation of the Colorado <br />Department of Transportation approval for such disturbance. <br />STATUS: Complied with by submittal of Minor Revision 215, May 15, 1997. <br />14 <br />
