STATUS: Complied with October 1, 1993 <br />Stinulation No. 51 <br />The Division 4 Water Court shall be notified of the new pond locations within 45 days of DMG's proposed <br />decision. In addition, a dam safety review shall be completed on MB-2 and MB-3 within 45 days after <br />construction of the ponds is completed. <br />STATUS: Complied with Apri13, 1995. <br />Simulation No. 52 <br />Minor revision 120 addresses construction of an exploration road to access two additional drill sites <br />(approved in MR-17). Submittal should include the exploration road with typical cross sections, details on <br />disturbance that will occur and reclamation work to be completed on this road once the project is <br />completed. <br />STATUS: Complied with April 12, 1994. <br />Stinulation No. 53 <br />All unresolved performance standazd issues and submittal requirements such as, but not limited to, <br />geotechnical stability issues, sediment control plans, bonding requirements, and revised page, map and/or <br />exhibit hazd copy submittals, shall be submitted and approved by the appropriate revision process, prior to <br />project initiation for technical revision no. 69. <br />STATUS: Complied with August 22, 1994. <br />Stinulation No. 54 <br />MCC and/or its consultant should either (1) prepaze and submit a more descriptive justification for the <br />selection of the mechanical properties used in completing the anatysis or (2) perform a sensitivity analysis <br />of the pile using the selection of coal refuse strength values contained in the earlier lower refuse pile <br />stability analysis. This information should be submitted on or before February 17, 1995. The disposal of <br />the coal waste should not begin until the information required has been previewed by the division. <br />STATUS: Complied with February 16, 1995. <br />Stnulation No. 55 <br />MCC must submit additional information regazding the repair plan for the haul road, including a plan view <br />of surface water drainage, cross section of buttress with refuse pile at final configuration and anything else <br />required as a result of the review of the design and stability analysis of the buttress. <br />STATUS: Complied with August 1, 1995. <br />Stinulation No. 56 <br />MCC must provide a signed copy of the agreement with the U.S. Forest Service, Paonia Ranger District, to <br />informally monitor the USFS surface water resources located above panels to be retreat mined or within the <br />angle of draw. The signed agreement shall be provided by May 31, 1995, to be incorporated into the <br />permit. <br />STATUS: Complied with May 4, 1995 <br />13 <br />
