Stipulation No. 44 <br />Revise Windy Gap policy calculations for annual net water depletion. Coordinate with the U.S. Fish and <br />Wildlife Service and provide all information to the Division to incorporate into permit. An application for <br />a technical revision to include the revised information should be received by December 31, 1992. <br />STATUS: Complied with February 1, 1993. <br />Stipulation No. 45 <br />Resolve outstanding issues from the ] 991 permit renewal (see specific information in the Division's letter <br />dated December 2, 1992). The information shall be submitted by December 30, 1992. <br />STATUS: Complied with February 2, 1993. <br />Stipulation No. 46 <br />An updated SPCC plan should be submitted to include in permit upon approval from the Colorado <br />Department of Health. <br />STATUS: Complied with Apri126, 1993. <br />Stipulation No. 47 <br />MCC shall submit revised maps and pages for minor revision no. 87. The revision addresses a repair plan <br />and stability analysis to repay the slide below the screening facility. Submittal should include the repair <br />plan, stability analysis, and any estimates for reclamation liability. <br />STATUS: Complied with June 21, 1993. <br />Stipulation No. 48 <br />MCC should submit revised maps and pages for minor revision no. 94. The revision addresses the <br />disposal of gob from the Beaz Coal Company, Beaz No. 3 Mine, in the Mountain Coal Company refuse <br />pile. Submittal should include three copies of revised section 2.05 in the permit document upon approval <br />of technical revision No. 64. <br />STATUS: Complied with September 7, 1993. <br />Stipulation No. 49 <br />Mountain Coal Company must address [he Division's assertion that a topsoil deficit for final reclamation <br />exists. If there is a deficit, MCC must provide a detailed plan specifying how the deficit will be <br />accommodated. If subsoil is designated as a suitable growth medium, then the permit should be revised to <br />specify how much subsoil will be utilized, where it will be stored and how it will be protected. A revision <br />addressing the above should be submitted to the Division on or before October 29, 1993. <br />STATUS: Complied with November 19, 1993. <br />Stipulation No. 50 <br />Ditch desigtts associated with the relocated topsoil pile should be provided by October 18, 1993, to be <br />incorporated into Exhibit 66. The designs should reflect storm events approved in technical revision 64 and <br />should be completed in association with technical revision 65. Until that time, ditches should be <br />constructed to have minimum designs as required by ditches Dl-4 and D2-20. <br />12 <br />
