ti ulation No. 37 <br />Mountain Coal Company will submit revised page 3-35 and exhibit 3.2.7.1A and bond calculations for <br />reclamation by August 6, 1989. <br />STATUS: Complied with August 7, 1989. <br />Simulation No. 38 <br />Mountain Coal Company will incorporate details or a reference to the weed control plan into the permit <br />application by September 14, 1990. <br />STATUS: Terminated September 26, 1990. <br />Stimulation No. 39 <br />Prior to the construction of the coal storage pad, a plan map must be submitted showing the proposed <br />topography ofthe pad. This map must show the location ofthe clean water ditches, sediment ditches, and <br />sediment trap and culverts. <br />STATUS: Complied with November 25, 1991. <br />Stimulation No. 40 <br />Prior to disturbing the azea of the storage pad, Mountain Coal Company must submit calculations to show <br />that the sediment pond receiving the runoff from the storage pad is sufficiently sized to handle the <br />calculated volume of water. <br />STATUS: Complied with November 25, 1991. <br />St~i ulation No. 41 <br />Prior to the importation of fill material to construct the coal stacking tube pad, Mountain Coal must submit <br />bond calculations and update the reclamation plan for the removal of the fill material. The source of the fill <br />material must be identified. If gob is to be used, this must be proposed as a technical revision and be <br />supported with designs that meet the Division's performance standazds for coal waste banks. Plans must be <br />certified by a qualified engineer. <br />STATUS: Complied with November 25, 1991. <br />Stipulation No. 42 <br />The information submitted with the technical revision and as part of stipulation responses must be <br />incorporated into the new reorganized permit application. Stipulation responses must be submitted as <br />minor revisions or, if gob is to be used as fill, that portion must be submitted as a technical revision. <br />STATUS: Complied with Febmary 2, 1993. <br />Stipulation No. 43 <br />MCC must submit as-built designs for all structures at the West Elk Mine site including, but not limited to <br />all surface facilities, dewatering system, portal bench and portal structures, water treatment plant, storage <br />tanks, attd waste water plant by December 30, 1992. <br />STATUS: Complied with :day 14, 1993. <br />11 <br />
