Stipulation No. 29 <br />Within ninety (90) days of approval of the lower waste pile permit revision, WECC shall submit a revised <br />water monitoring plan that includes monitoring of the waste pile. The plan shall include direct sampling of <br />the sediment pond and undersrains dischazge twice per yeaz during the second and third quarter of the yeaz. <br />The parameters shall be the full list of chemical constituents, at least for the fast year. WECC may request <br />an adjustment of the monitoring requirements after the fast year, depending on the results of the <br />monitoring. <br />STATUS: Complied with May 19, 1986. <br />Stipulation No. 30 <br />MCC must submit additional bond, in the amounts described in the lower waste pile permit revision <br />application, at least thirty (30) days prior to the commencement of construction of phases III, IV, and V of <br />the lower waste pile. These additional bonds must be approved and accepted by the Division prior to <br />construction for these phases. <br />STATUS: Terminated May 28, 1992. <br />Stipulation No. 31 <br />MCC shall forwazd five (5) copies of [he Colorado Department of Highways' writer approval far activities <br />within 100 feet of the outside right-of--way of Colorado Highway 133 within thirty (30) days of approval of <br />the permit revision application. <br />STATUS: Complied with July 28, 1993. <br />Stipulation No. 32 <br />The applicant shalt monitor the two monitoring wells located over the first panel to be subsided one year <br />prior to mining this panel. The applicant shall submit to the regulatory authority groundwater level data <br />and water quality data prior to mining this panel. <br />STATUS: Future <br />Stipulation No. 33 <br />Should the applicant encounter more groundwater than anticipated, prior to the discharge of excess mine <br />water, the applicant shall provide an analysis of anticipated water quality and quantity, and an assessment <br />of the effects on the receiving stream. <br />STATUS: Terminated May 28, 1992. <br />Stipulation No. 34 <br />Mountain Coal Company shall collect at least one composite representafive sample of the dischazge water <br />from the old portal and have it properly analyzed for the following parameters: <br />pH (field) Aluminum <br />conductivity at 25C Arsenic <br />Temperature (field) Cadmium <br />dissolved Oxygen (fld) Copper <br />TDS Iron <br />SAR dissolved Iron <br />
