Page 20 <br />Construction Materials Rule <br />assigned by the Office and all factual and legal questions which the Applicant <br />wishes to have the Boazd decide. <br />1.4.8. Regular 112 Permit Approval -Over an Objection <br />If the Office issues a decision to approve of an application for which it has <br />received an objection, it shall schedule the application for a hearing before the <br />Board. Such heazing shall be scheduled prior to the deadline for a fnal <br />decision. on the application pursuant to Section 34-32.5-115(2), C.R.S. 1984, <br />as amended. <br />1.4.9 Appeal of Regular 112 Permit Approval <br />Any party objecting to the approval of the application shall, within ten (10) <br />days of the receipt of written notice, of the approval, file a statement of the <br />issues to.be considered by the Board at the heazing. The statement shall <br />include an explanation of the grounds for seeking a reversal of the Office's <br />decision. <br />1.4.10 Appeal of Regular 112 Permit Denial <br />If the Office issues a decision to deny an application, it shall schedule the <br />application for a hearing before the Boazd. Such hearing shall be scheduled <br />prior to the deadline for a final decision on the application pursuant to Section <br />34-32.5-115(2), C.R.S. 1984; as amended. <br />(a) Within ten (10) days of receipt of the letter of denial, the <br />Applicant shall file a statement of issues to be considered by. the Boad <br />at the hearing. The statement shall include an explanation of the <br />grounds for seeking a reversal of the Office's decision. <br />(b) If there are no other parties to the proceedings on the <br />application the Applicant may waive the statutory deadline for a final <br />decision. In that event, the Applicant shall file the statement of issues <br />to be considered by the Board at the hearing within sixty (60) days of <br />the receipt of the letter of denial. <br />1.4.11 Automatic Application Approval <br />
