.Page 19 <br />Construction Materials Rule 1 <br />(2) At the lrtformal Conference, each person objecting to the <br />approval of the application shall set forth the grounds for the objection. <br />Similazly, the Applicant, and any other person supporting the approval of.the <br />application, shall present the grounds necessary to support the approval.- <br />(a) Any interested person may participate in the Informal <br />Conference by submitting written comments or by appearing in person. <br />(b} If any person maybe affected or aggrieved by Office or <br />Boazd action, that person may petition the Office for admission as a <br />party to the matter before the Board. Such a petition shall be in writing <br />and shall set forth a brief and plain statement of the facts which entitle <br />that person to be admitted as a party and the matters which the person <br />claims should be decided. The written petition for party status shall be <br />submitted to the Office at the Informal Conference or within five (5) <br />working days after the Informal Conference. Parties to any matter <br />before the Boazd shall continue to be parties to any action for judicial <br />review following final agency action, pursuant to Section 24-4-106(4), <br />C.R.S., as amended. <br />(c) Any issue raised orally, that was not previously <br />submitted in writing, by any person at the Informal Conference shall be <br />submitted in writing to the Office by such person within five (5) <br />. working days after the Informal Conference. <br />(d) The parties to a subsequent heazing before the Boazd <br />may not present any claim supporting the approval or denial of the <br />application unless such claim was first presented to the Office at the <br />Informal Conference. The Boazd, or its designated pre-heazing <br />conference officer, may, in its discretion, grant an exception to this <br />provision for good cause shown. <br />1.4.7 Administrative Appeal -110,110(6), and 111 Operations <br />Any person aggrieved, by any final action of the Office, may file an appeal of <br />such action before the Boazd within sixty (60)-days of the date of the Office , <br />decision (such heazings before the Boazd shall comply with this Rule and the <br />' State Administrative Procedures Act, Section 24-4-105 and 106, C.R.S.). The <br />Request for Administrative Appeal must sgecify the application number <br />
