PCPC <br />Re: Special Use Permit No. 596 <br />August 17, 1993 <br />Page 2 <br />• <br />The Pueblo County Planning Commission first approved this special use <br />permit on September 4, 1986. The PCPC approved one year reviews on <br />August 25, 1987 and August 24, 1988 with the following conditions: <br />(1) The applicant shall obtain a State highway access permit for <br />access from Baxter Road and 36th Lane before these access points <br />are used in the mining operation. A copy of the access permits <br />shall be provided to the Department of Planning and Development <br />within 30 days of issuance. <br />(2) The applicant shall access property under SUP No. 596 with heavy <br />equipment (semis, dump trucks, loaders, scrapers, etc.) only via <br />approved accesses from U.S. Highway 50, State Highway 233 <br />(Baxter Road) and State Highway 231 (36th Lane). <br />- -(3) The applicant shall provide the Departmerifof Planning and <br />Development with a copy of any future MLRB applications, permits <br />or amendments within 30 days of their submittal to and/or approval <br />by MLRB. <br />(4) The applicant shall provide to the Department of Planning and <br />Development a copy of any further State or Federal permit <br />applications (i.e., access, NPDES, 404, etc.) and approval thereof <br />within 30 days of said application or approval. <br />(5) Regarding Lot 9 of the Hartman and Wilcox Subdivision, should <br />Valco acquire said property, then Valco shall supply the <br />Department of Planning and Development with a copy of the deed <br />within 30 days of its acquisition. Should that sale not occur and <br />should Mr. Stringer sell that parcel to another party, Valco shall <br />provide the Department of Planning and Development with a <br />statement from the new owner approving the inclusion of Lot 9 in <br />SUP No. 596 within 30 days of said sale. Should Mr. Stringer <br />retain ownership of said Lot 9 and choose to not have it included <br />in SUP No. 596, then Valco shall amend the special use permit, <br />removing said Lot 9 from the permit area. <br />(6) Within 60 days of this August 23,--1988 approval, the applicant <br />shall provide the Department of Planning and Development with <br />copies of recorded plats showing boundary line agreements that <br />have affected the boundary of this special use permit since <br />September 4, 1986, noting the effect, if any, on the total acreage <br />of SUP No. 596. The applicant shall so notify the Department of <br />Planning and Development of any future changes in the SUP <br />boundary, within 30 days of said change. <br />(7) Special Use Permit No. 596 shall be reviewed in five years <br />(August, 1993) or one-year after mining becomes fully operational, <br />whichever occurs first. The applicant shall notify the Department <br />of Planning and Development of the commencement of mining <br />activities within 30 days following start-up. <br />
