Access Roads <br />The landowner has requested the retention of the access road <br />depicted on Figure 4.2-3. Its retention is compatible with the <br />approved post-mining agricultural land use. Therefore the Division <br />proposes to approve retention of the access road (4.03.2(1)(f>). <br />See page 4-62 of the permit. <br />C. Light Use Roads <br />The applicant requires certain light use roads constructed under an <br />exploration plan approved by the Division to reach hydrologic monitoring <br />stations during the renewal period. <br />These roads are shown on figures 4.2-3, 4.2-4, and 4.2-5. The road <br />designs meet all the requirements of Rule 4.03.3. These roads are <br />planned to be left as part of the post-mining land use as requested by <br />the landowners. NCIG Financial, Inc. from its letters to landowners, <br />however, has committed to "reseed the surface, cuts and fills for these <br />roads to control erosion." Water Quality Standards and Effluent Limitations <br />The Division proposes to grant a 2.96-acre small area exemption from <br />the use of sediment ponds due to the limited size of the area and <br />due to the fact that ponds and treatment facilities are not <br />necessary for the drainage to meet the effluent limitations of Rule <br />4.05.2 and applicable State and Federal water quality standards for <br />receiving steams, and also due to the fact that no mixing of surface <br />drainage with a discharge from underground workings will occur. The <br />small areas to be exempted are topsoil piles 1, 2, 4, 5 and 6, the <br />powder magazine, pump house, waterline permit corridor and <br />ventilation pipes.
