the Soil Conservation Service that demonstrates that no prime farmland <br />mapping units are found with the permit area (2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has <br />determined that three alluvial valley floors exist within the permit or <br />adjacent area. The alluvial valley floors are known as the Colorado <br />River AVF, the Alkali and the South Canyon AVF, but only the Colorado <br />River AVF will be potentially affected by Coal Ridge No. 1 Mine <br />operations. Alkali and South Canyon Creek lie outside the disturbed area <br />of the mine. <br />For additional specific findings concerning this alluvial valley floor <br />please see permit Section 5.0, pages 5-1-5-19, and the Alluvial Valley <br />Floor findings section in this document. <br />13. The Division hereby approves the post-mining land use of the operation. <br />It was determined that cropland grazing, developed water resources, <br />undeveloped land and industrial (for the loadout facility) meet the <br />requirements of Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals <br />are addressed in the following section, Section B (2.07.6(2)(m)>. <br />15. The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species or <br />result in the destruction or adverse modification of their critical <br />habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, the operator is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R <br />(2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4. <br />Roads - Rule 4.03 <br />A. Haul Roads <br />Alternative criteria and specifications were used during the design <br />of haul roads. These criteria and specifications are proposed for <br />approval by the Division following an analytical demonstration that <br />the roads will be environmentally sound and reclamation can be <br />achieved. The proposed criteria and specifications pertain to haul <br />and access roads. The original Findings Document included <br />Stipulation No. 7 concerning the design for the main access road <br />(see Figure 4.2-4 in the permit). This stipulation was subsequently <br />amended by the Division when NCEC submitted Technical Revision 1. <br />The amended stipulation required a certification report showing <br />compliance with the construction requirements of Rule 4.03.1 and <br />-15- <br />
