compliance review required by the Colorado Surface Coal Mining <br />Reclamation Act, the Division finds that NCIG Financial, Inc. does not <br />own or control any operations which are currently in violation of any <br />law, rule, or regulation of the United States, or any State law, rule, or <br />regulation, or any provision of the Surface Mining Control and <br />Reclamation Act or the Colorado Surface Coal Mining Reclamation Act <br />(2.07.6(2>(g)(i)). <br />8. The applicant or operator does not control and has not controlled mining <br />operations with a demonstrated pattern of willful violations of the Act <br />of such nature, duration, and with such resulting irreparable damage to <br />the environment as to indicate an intent not to comply with the <br />provisions of the Act (2.07.6(2)(h)). <br />9. The Division finds that surface coal mining and reclamation operations to <br />be performed under this permit will not be inconsistent with other such <br />operations anticipated to be performed in areas adjacent to the permit <br />area (2.07.6(2)(1)). <br />10. The Division currently holds reclamation bond in the amount of <br />$288,000.00 for the Coal Ridge No. 1 Mine. The bond is in the form of <br />three certificates of deposit (CD No. A34643 for $100,000.00, <br />CD No. A34508 for $100,000.00, and CD No. 6733 for $88,000.00). Based <br />upon a reevaluation of estimated reclamation costs for proposed <br />operations at the Coal Ridge Mine, the Division estimates that bond in <br />the amount of $420,959.00 is required. This figure includes the <br />$29,354.00 estimate for reclamation of the refuse pile contained in <br />Stipulation No. 22. With the addition of a new stipulation (No. 24), <br />Stipulation No. 22 is no longer necessary and is being deleted from the <br />permit. <br />NCIG must submit an additional $132,959.00 of bond prior to construction <br />of facilities in the mine plan which are not presently in place. <br />Therefore, the following stipulation is being added to the permit: <br />Stipulation No. 24 <br />PRIOR TO THE INITIATION OF CONSTRUCTION OF SURFACE FACILITIES WHICH <br />ARE NOT ON SITE AS OF NOVEMBER 17, 1992, THE PERMITTEE WILL SUBMIT <br />BOND IN THE AMOUNT OF $132,959.00. THIS BOND MUST BE RECEIVED AND <br />APPROVED BY THE DIVISION PRIOR TO THE INITIATION OF CONSTRUCTION OF <br />ADDITIONAL FACILITIES. <br />The estimated cost of reclamation for the mine and loadout is $420,959.00 <br />(2.07.6(2)(j)). An additional amount of $132,959.00 will be submitted <br />and approved by the Division for construction of the proposed surface <br />facilities tsee Stipulation No. 24). <br />The above bond amount reflects the Division's projection of reclamation <br />costs for worst-case disturbance which will occur during the proposed <br />permit term (2.07.6(2)(j)). <br />11. The Division has made a negative determination for the presence of prime <br />farmland within the permit area. The decision as based on a letter from <br />-14- <br />
