-18- <br />frre State of Colorado has acknowledged drat ~nininy operations do cause <br />dust and iri so doiny has passed the Colorado Nir Pollution Control Nct. <br />The result is that this rniniriy operation must obtain an emissions permit <br />from the Colorado Uepartrnerrt of Health, Nir Pollution Control Uivision. <br />Sunland 1~linirrg Corporation has received an initial emissions pennit with <br />specific conditions as follows: <br />1. Opacity of emissions shall not exceed `LU;b from any <br />processing activity. <br />2. Coal shall be wet as mined, or a dust suppressant <br />system shall be employed to reduce any dust <br />emissions resultiny from coal processing. <br />3. Vehicle speeds shall not exceeu 2U mph on the <br />property. <br />4. koads shall ue watered if fuyitive dust from vehicle <br />tracffic is excessive. <br />The applicant has demonstrated on page 188 of the application that each <br />point source discharge of tyre rnininy operation has been desiyned to <br />minimize particulate emissions. Urr-site inspections uy the Uivision <br />corrfirrn that very little riust is produced during coal processirry. <br />However, oust from the county roar) does cause considerable particulate <br />yeneratiorr. The applicant has committed to [Ire conditions of the <br />emissions permit to reduce dust generation from the county road. <br />XI. Soils - kolas 2.Uv.9, t.u~.3(5), L.US.d(2)(d) anu <br />4.U6 <br />Information dealiny with soils resources and topsoil Irandliny procedures <br />can be located un payes 83-92, 18U and 183 of the permit application. <br />Since the facilities area was uisturbed prior to the enactment of the <br />Surface Plininy Control anU keclamation Nct (SI1CitN}, no baseline soils <br />information from the disturued area is availiable. In addition topsoil <br />was not salvayed prior to mininy. Ns was discussed in the Description of <br />the Existiny Environment Section of this document, soil samples were <br />taken in adjacent areas to provide information for reclamation planniny. <br />Initially the applicant proposed to import topsoil of a volume sufficient <br />to cover the mine yard area with a b inch depth. The Uivision does not <br />reconmend disturbiny areas which heretofore were undisturbed to obtain <br />topsoil for reclamation within the permit area. Since the mine is <br />proposed to continue in operation for more than lU years, anti4ipating <br />soil availability is impossible. Therefore, the recianration plan was <br />evaluated as thouyh no soil were to ue imported and the applicant would <br />provide a suitaule plant yrowtlr mrrdiuni for revegetation purposes. The <br />suitaule plant growth medium will be composed of non-toxic material from <br />tiro site, plus a~nerrd~nerrts. lire Uivision has evaluated the analyses of <br />the on-site material and it is suitable. This suitaule yrowtir mediwn <br />will ue tested for for texture, pH anu either SNR(sodium absorbtion <br />ratio) or tC (electro-conductivity) at tyre tune of reclamation. <br />
