_'~ _

1. Underground development waste will be deposited
into worked-out pillar areas or in other permitted
areas.
2. The dip of the strata and the mine workings is away ,
from Trout Creek; and
3. Over 817 of the mine workings are above the
piezometric surface.
Therefore, the Division concludes that there will be no adverse effects
from the mininy operation due to leachate development from waste
material, mine drainage, or dewatering the alluvial aquifer.
A cumulative hydrologic assessment of effects of coal mining on the Yampa
River Basin was prepared for the Division by the consulting firm of Kaman
Tempo. The report stated, "The Apex No. 2 Mine appears to have
negligible off-site impacts to the hydroloyic balance." The Division has
evaluated the potential impacts of the Npex Mine to the fydrologic
balance in more detail since the Kaman Tempo study. The additional
hydrolggic data analysis confirms the statements of the Kaman Tempo study
that there will be negligible off-sites impacts to the hydrologic
balance. Even though the potential for impact is minimal, Sunland Mining
Corporation has proposed to continue ~rionitoring the spring flow, mine
inflows, surface and alluvial water flows for both quality and quantity
of water to substantiate the predictions.
The assessment of the probable cumulative impacts of all anticipated coal
mining in the general area on the hydrologic balance, as described in
2.05.6(3), leas been made by the Division, and the operations proposed
under the application crave been designed to prevent damage to the
hydrologic balance outside the proposed permit area.
X. Climatolo ical Information and Air Resources Protection-
Rules 2.04.8, 2.05.4 2 h 'L.05.6 1 and 4.17
The appropriate information dealing with climatology and air resources at
the site is contained in Section 2.04.8 pages 71-82 of the permit
application. The applicant included very detailed weather information
from the Pyramid cooperative weather station location 6 miles southwest
of the permit area.
On March 8, 1981, Mr. and Mrs. Yorty, adjacent landowners, expressed
concerns about air resource protection. The comments addressed dust
problems that were detrimental to Mr. Yorty's asthmatic condition.
