C <br />January 28, 1985 <br />Mr. Lawrence White <br />Page 2 <br />In your stipulation status letter of November 6, 1984, it is stated <br />that Twin Pines is contemplating an outside source of water for use at <br />and within the mine; therefore, use of mine water may not be <br />necessary. The Division has no major concern with this, except that <br />prior to a change in water use plan, a Minor Revision must be submitted <br />and approved for this activity. <br />Stipulation No. 4: <br />This stipulation addresses the handling of topsoil in the Lewis Gulch <br />Fill Area and reclamation of this area. The original concern, as was <br />stated in the Findings Document (page 30), was with Twin Pines' <br />proposal to distribute the salvaged topsoil from this area on the <br />slopes of the Lewis Gulch Filt embankments. Since this fill area must <br />be removed during site closure and reclamation, this plan was not <br />acceptable and an alternative plan for topsoil storage and <br />redistribution was required (see Findings Document, page 30). <br />In your stipulation status letter of November 6, 1984, it is stated <br />that topsoil from the Lewis Gulch Fill area will be removed and placed <br />in a temporary stockpile with subsequent redistribution on the highwall <br />fill slope above the bench. This disallows redistribution of this <br />topsoil back onto the Lewis Gulch Fill area, once the fill is removed. <br />However, given that the highwall fill slope is a more critical area in <br />terms of stability and revegetation success, it would be prudent to <br />place topsoil on this area as soon as possible. The plan for <br />reclaiming the Lewis Gulch Fill area is outlined on page 88 (rev.) of <br />the permit, and includes grading, seeding, and mulching of this area. <br />This plan is acceptable as outlined in the permit and your stipulation <br />status letter, and no further response to this stipulation is required. <br />Stipulation No. 5: <br />Prior to any reseeding of backfilled and graded areas, Twin Pines is <br />required to submit a proposed test program for testing of the seed bed <br />material. In your stipulation status letter, it is stated that <br />sampling will be accomplished with the assistance of the local Soil <br />Conservation Service office; however, more specific information on the <br />number of samples to be taken and the parameters to be analyzed has not <br />been presented. The Division considers four representative sample <br />locations to 'oe aequate for the Twin Pines No. 2 area, and samples at <br />each location should be composited into six-inch increments down to <br />30 inches. <br />Your response to this stipulation should specifically include reference <br />to the number of samples to be collected and analyzed, tfie parameters <br />to be analyzed for, and a committment to follow any recommendations <br />made by tine Soil Conservation Service and Colorado State University. <br />
