White <br />Consulting Engineer for <br />Twin Pines Investment Limited Partnership <br />1650 M Street <br />Penrose, Colorado 81240 <br />Re: Stipulations to Permit No. C-058-83 <br />Dear Mr. White: <br />The purpose of this letter is to advise yo of our review of the stipulations <br />to Permit No. C-058-83, which was granted December 17, 1984. Your <br />stipulation status letter of November 6, ;4 has been included in this <br />review. There are nine stipulations; they ire briefly discussed below. <br />Stipulation Nos. 1 and 2: <br />These stipulations direct that thF ~ermittee (hereafter referred to as <br />Twin Pines) submit quarterly reports for well monitoring and mine water <br />balance. The purpose for requiriny this monitoring, as stated in the <br />November, 1983 Findings Document, is in order to verify the prediction <br />of probable hydrologic consequences and to monitor any hydrologic <br />impacts from the mining operation. The initial report will be due on <br />April 16, 1985, thirty days after the end of the first quarter. During <br />the final meeting with MLRD prior to permit issuance, Twin Pines <br />indicated a desire to revise the hydrologic monitoring program. In <br />order to initiate t;ris process, Twin Pines should submit a Technical <br />Revision application, as per Rule 2.08.4(5)(b), that specifically <br />requests the desired changes to the monitoring program and the reasons <br />for them. If there are any questions related to submittal of a <br />Technical Revision request, please contact the Division. <br />Stipulation No. 3: <br />This stipulation states that Twin Pines must obtain all applicable <br />state permits prior to use or dewatering of mine water. This <br />stipulation is required to ensure compliance with Colorado Water Law. <br />If Twin Pines should decide to put mine water to belreficial use, a well <br />use permit would be required from the State Engineer's Office.
