<br />January 28, 1985 <br />Mr. Lawrence White <br />Page 3 <br />Stipulation No. 6: <br />This stipulation refers to submittal of revegetation success standards <br />within 90 days of p~nait issuance. In the stipulation status letter, <br />reference is ~nade to page 88 of the permit for the proposed <br />revegetation standards. On this page, Soil Conservation Service <br />production information is provided, but there is no committment made to <br />meet this production. Also, it is somewhat unclear as to what is meant <br />by "30 percent production" on page 88. Was this information included <br />for use as a success standard? If so, this should be clarified. If <br />not, does Twin Pines agree to the general standards set forth in this <br />stipulation? Agreement to these general standards is all that is <br />required in order to satisfy this stipulation. <br />Stipulation No. 7: <br />As stated in your stipulation status letter, a sediment trap will be <br />excavated at the inlet of the Lewis Gulch fill culvert. No further <br />response to this stipulation is required. <br />Stipulation No. 8: <br />This stipulation requests a demonstration that adequate material exists <br />to cover the underground development waste pile in accordance with Rule <br />4.11.4(2). The stipulation status letter states that the underground <br />developement waste disposal area will be covered by two feet of <br />material which will be available from the toe dike and Lewis Gulch <br />fill. This demonstration is adequate to satisfy this stipulation and <br />no further response is required. <br />Stipulation No. 9: <br />This stipulation requires that additional information be submitted for <br />the reclamation plan for the Twin Pines No. 1 portal area prior to <br />producing coal from the Twin Pines No. 2 Mine. Information on the <br />reclamation plan is included in the permit application under Section <br />2.06.10, page 98. A specific response is still needed to the following <br />items listed below: <br />a) Removal and reclamation of the sediment pond area <br />b) The final highwall height after backfilling and regrading <br />c.) Testing of the seed bed material to determine the need for soil <br />amend~aents to ensure revegetation success <br />d) The quantity per acre and type of seed mix and mulch to he used on <br />the area <br />
