<br />crushed limestone, thermal protectionldrain layer, and topsoil, LAC Minerals may use <br />LAC personnel in CQA functions under the oversight of the designated CQA consultant. <br />6. In conjunction with plans and specification approval, conditions placed on CQA methods, <br />monitoring, testing, sampling and documenting, shall be considered permit conditions. <br />The conditions placed on the CQA plan will not alter the conceptual design of the facility <br />as permitted. LAC Minerals may request a hearing before the Board to contest any <br />conditions placed on the CQA plan approvals. <br />7. As part of the CQA plan, LAC Minerals shall submit to the Department for approval a <br />pL~n to monitor settlement of the completed impoundment. <br />LAC Minerals shall submit an additional $2,388,707.00 of reclamation surety to bring <br />their total reclamation surety to $10,700,000.00. The Department and the Board reserve <br />the right to adjust, pursuant to SDCL 45-6B-21, the reclamation surety as necessary. <br />2. Prior to reclamation surety and liability release, in addition to reclamation and revegetation <br />requirements, water quality at the site must meet water quality standards as determined by <br />LAC Minerals' NPDES permit, and South Dakota Surface Water and Ground Water <br />Standards as applicable. <br />The postclosure period shall begin at the time of reclamation surety release (mine closure) <br />and shall last for a period not to extend beyond 30 years, unless the Board of Minerals and <br />Environment determines that a longer or shorter period of time is necessary for compliance <br />with all applicable performance standards or design and operating criteria. <br />2. LAC Minerals' liability for the affected mine area shall continue until certification of the <br />completion of the postclosure care is approved by the Board. <br />3. LAC Minerals shall grant to the Board, or its representatives, permission to enter the <br />reclaimed area to monitor reclamation success and to take air, water, and biological <br />samples during the postclosure period. LAC Minerals shall be given the opportunity to <br />accompany any inspector from the Department or other agent of the Board during the <br />postclosure period. <br />4. Prior to the start of the postclosure period, LAC Minerals shall submit conceptual <br />contingency plans to the Department for approval in the case any completed component <br />of the facility, including the waste impoundment and the waste rock left in the South <br />Waste Dump begin to generate acid mine drainage.
