<br />May 21, 1979-~ An agreement is made between Western Slope Carbon <br />alts County to dump coal waste in the vicinity of the <br />landfill. In return for the permission of County and Owner for <br />usage Western Slope agrees to the following: <br />- $6 load of 12 tons or less <br />- $9 load in excess of 12 tons <br />- Comply with lease of 1977 (mentioned above) <br />- No other Coal Company will use the site without prior <br />approval of the County and Owner. <br />- Coal company agrees to be responsible for compliance <br />with all laws and regulations pertaining to use of the <br />site as a coal waste dump site. <br />- Terms are for one year, but at the end of the year the <br />parties may mutually agree to extend the term for <br />additional years. <br />The Mined Land Reclamation Board a all or an <br />appropriate part of a performance bond for any permit as forfeited <br />if the board determines that any of the following circumstances <br />exist: <br />(a) The permittee has violated any of the terms or conditions <br />of the bond and has failed to take adequate corrective action. <br />(b) The permittee has failed to conduct the surface mining <br />and reclamation operations in accordance with the Act, these rules <br />and the permit within the time required, and that it is necessary, <br />in order to fulfill the requirements of the permit and the <br />reclamation plan, to have someone other than the permittee correct <br />or complete reclamation; <br />(c) The permit has been suspended or revoked, and neither the <br />permittee nor the surety has assumed liability for completion of <br />reclamation work under a compliance schedule approved under Rule <br />3.04.1(2) or; <br />(d) The permittee or surety has failed to comply with a <br />compliance schedule. <br />.The proceeds_of_foLfeit~d bonds shall be deposited by~.he_Di~ision <br />in a separate reclamation account available to the Division.
