No bond shall be totally released prior to successful <br />c moc pletion of all reclamation under the terms of the permit, <br />including the applicable liability periods and release. <br />Refuse Disposal and Reclamation Plan <br />This specification covers all materials and work required to handle <br />coal and coal waste material existing on the surface and <br />encountered in excavations, and for ripping portions of final <br />regraded surfaces to alleviate surficial compaction. The coal <br />waste material will be removed from the coal silo facility area and <br />placed in the Hawk's Nest Refuse Disposal Area in Hotchkiss. <br />A. Classification of Excavated Materials <br />The coal material consists of the remains of the coal <br />stockpile, coal spillage along the ground surface beneath the <br />coal conveyors, and coal spillage over the embankments of the <br />coal stockpile area. Coal waste consists of coal material <br />which has oxidized or degraded over time due to prolonged <br />exposure to the elements. The coal/coal waste material is <br />easily distinguished from the non-coal material by marked <br />differences in color and consistency. No additional <br />allowances will be made on account of any of the material <br />being wet or frozen, or additional work required to remove and <br />dispose of coal/coal waste material, large rocks and boulders, <br />subsurface utilities, and mining related features encountered <br />within excavated areas. The CONTRACTOR shall assume all <br />responsibility for deductions and conclusions as to the nature <br />of the materials to be excavated, the difficulties of making <br />and maintaining the required excavations, and the presence and <br />extent of coal/coal waste material, large rocks and boulders, <br />subsurface utilities, and mining related features within areas <br />to be excavated. The OWNER does not represent that the <br />excavation can be performed or maintained described in these <br />specifications. <br />B. Removal • ~~{ ~' ~ C1~ ~ ~Dr <br />The CONTRACTOR shall remove the coal/coal waste loc ted in the <br />Coal Storage area and Coal Silo Facility area depicted on map <br />2A and 2B. The CONTRACTOR is solely responsible for <br />determining and verifying all quantity estimates and pricing <br />bid amounts accordingly. No additional allowances above the <br />price bid will be made on account of actual quantities of <br />material moved being different than the estimated quantities. <br />All coal/coal waste material shall be hauled to the Hawk's <br />Nest Refuse Disposal Area depicted on Exhibit 4. Theme Refuse <br />Disposal area is located in Hotchkiss, and is roughly~:9~miles <br />from the Silo Facility area. All coal\coal waste material <br />shall be placed in the south west end of the trench. See <br />Exhibit 5 for location of coal\coal waste placement. The area <br />for placement will be marked by the PROJECT MANAGER. <br />
